Hon. Temporary Deputy Chairman, I beg to move: THAT, the Schedule to the Bill be amended in the proposed amendments to section14 of the Kenya Post Office Savings Bank Act by inserting the words “in consultation with the Cabinet Secretary” immediately after the word “Registrar”.

The import of this is that when there is dispute between the bank and an individual depositor there is normally an arbitrator who is appointed by the Registrar of Nairobi Centre for International Arbitration. We are now providing that this arbitrator should work in consultation with the Cabinet Secretary. This role in the parent Act is undertaken by the Cabinet Secretary. Now that it is being moved to the Registrar then he should not do it alone but must consult the Cabinet Secretary responsible for finance matters.

It was concerning the implementation status of what we passed in this House in the Finance Bill, which were actually regulations governing banking issues in this country. As the Departmental Committee on Finance and National Planning, we were unable to meet the Governor of the Central Bank of Kenya (CBK), together with the members of the Kenya Bankers Association (KBA). This is because the Governor is away. Therefore, I ask for more time so that we can respond to this Question next week on 15th November.

Hon. Temporary Deputy Chairman, the issue which has been raised is whether a Member can amend an amendment which has been moved by another Member. That is very important because if we do not clear that properly, it will set a precedent. So, the right thing to do is that the Member who intends to move a further amendment has to convince the Mover of the original amendment. In this case, if Hon. Duale will be convinced, that will be right, but if not, then Hon. Kioni’s amendment will fall.
