Mr. Deputy Speaker, Sir, on 20th July, 2009, Dr. Khalwale rose on a point of order to seek a Ministerial Statement from our office, regarding what he termed as harassment of reporters by the police. I wish to state as follows:- Mr. Deputy Speaker, Sir, the Star Newspaper published a story in their edition No.635 captioned: Fazul Dossiers Missing from Malindi 2008, Mombasa 2002. Mr. Deputy Speaker, Sir, I will start with Dr. Khalwaleâs clarification. First, the reporters were not under arrest at all. They were summoned - and I have evidence which I can lay on the Table of the House - to explain their source of the story. I wish to lay the document on the Table for ease of reference.

Mr. Deputy Speaker, Sir, we do not arrest those who accurately come up with a story. The reporters were summoned to explain the source of their story. This is what the summons say: âExplain to the officer the source of the information on your edition No.635 of 20th July.â That, in itself, does not necessarily mean that they were arrested.

Mr. Deputy Speaker, Sir, I went a notch higher and spoke to some of those reporters. They indicated to me that they were not arrested. They were required, through the summons, to explain.

Mr. Deputy Speaker, Sir, you will agree with me that we are not in a court of law. Those reporters were never charged. I have evidence here to show that. The other clarification that Dr. Khalwale wanted was for the Government to apologise. He wants us to apologise for what and yet, the reporters were never charged? So, why should we apologiSe? I want to make it clear here that the police officers never intimidated or harassed those reporters. If there is any evidence to the contrary, I will take stern action to any police officer who harassed or intimidated ...

Mr. Deputy Speaker, Sir, I beg to reply. (a) It is true that the OCS Pap-Onditi operates in a single unihut which serves as the report office, it also holds the amoury still box and a radio room. However, this financial year, the Police Department was allocated inadequate funds towards developing police housing and accommodation. It might not be possible to change the current situation immediately. Mr. Deputy Speaker, Sir, I would have considered this particular station for the construction of houses but we do not have enough funds. I ask the hon. Member to bear with us for some time and if we have enough funds, it will be prioritized. In the meantime, we will provide some unihut as a stop-gap measure in order for services to continue. I have also spoken to him and we agreed that we look for some stop-gap measure for the continuity of the services within that particular station.
