On a point of order, Mr. Speaker, Sir. Is it in order for the Minister to mislead the entire country that he has power and authority to disregard a board set up by the Act which entitles him to appoint? In that case, what did we do with Justice Ringera? Did the President not have the authority to recommend regardless of what we had in mind?

What did we do with the defunct Electoral Commission of Kenya (ECK)? Did we not disregard the Constitution about removing the Commissioners? Is that the direction we want to go? Could the Minister, therefore, confirm that there is no need even for the Departmental Committees to take up this case because Ministers have impunity to do whatever they want regardless of the law?

Mr. Deputy Speaker, Sir, you have just given a ruling which I do not wish to challenge. But it arises from the Prime Ministerâs Statement that, if a Minister, Member of Parliament or anybody else is under investigation and, Mr. Moreno- Ocampo finds it so, they will be required to vacate office under the Public Officer Ethics Act. That is what he said. If that Act is still valid, what will happen to those with cases which are ongoing? We are not imputing any motive against any other Member. On a point of order, Mr. Deputy Speaker, Sir. We are not just debating the performance of Justice Ringera; that is a fact. We are not debating the performance! This is not a tribunal to remove Justice Ringera from office. Was the proper procedure used to re-appoint him? That is what we are supposed to discuss. So, if you want to discuss the conduct or evaluate his performance, that is a different thing altogether.
