Pursuant to Standing Order No.48, I beg to move this Motion in an amended form. This amendment is to replace “140” with “182”. This is about 182 constituencies whose nominees have been approved by the Board and, equally, the Committee which I chair. We are now seeking the approval of this House. With those remarks, I beg to move and request the Vice-Chair to second.

Thank you, Hon. Temporary Deputy Chairman. I stand to support the position of the Committee. This sub-section is very necessary. I am opposing Hon. Emanikor for exactly the reason that the Chairman of the Committee has given. This sub-clause is necessary where there is no response on bids, or where the bids do not meet the minimum requirements. Therefore, I oppose the amendment.

Thank you, Hon. Speaker. I want to make a very brief report. The new National Government Constituencies Development Fund Act, 2015 has been in operation from 19th February 2016. The regulations also came into effect on 30th March 2016. Pursuant to those regulations, I would like to inform the House that the following 23 constituencies have nominated nominees to the constituency committees, popularly known as the Constituencies Development Fund Committees. Yes. That is what I am saying. This House and specifically the Committee on Delegated Legislation has finalised them and has successfully approved and forwarded to the CDF Board who have now sent them to the Attorney-General for gazettement. The process on the other side of Government is that all regulations for gazettement must be processed through the Attorney-General. So, it is just on transit to the Government Printer for that gazettement. I am very optimistic that the issue of gazettement should happen this week. Thank you.

Thank you, Hon. Speaker. Yes, I accept the offer by Hon. Duale, the Leader of the Majority Party, to take up the matter with the Attorney-General. For purpose of information and specifically to Hon. Jakoyo Midiwo, this House has already approved the regulations through the Committee on Delegated Legislation led by Hon. Cheptumo. For that matter, the regulations are not coming to this House. This amendment seeks to clarify that the National Assembly is involved in oversight functions. It also seeks to affirm that the role of the Member of the National Assembly is to oversee the management of the Fund. It is basically a minor amendment. I thank you. Hon. Temporary Deputy Chairlady, I beg to move:- THAT, Clause 6 of the Bill be amended in sub clause (1) by deleting the words “with the concurrence of” and substituting therefor the words “with the approval of”. This amendment is basically to delete where we are saying “with the concurrence of” to make it “with the approval of.” It is just a bit of semantics and it is a simple amendment.
