Madam Temporary Deputy Chairlady, I beg to move:- THAT, Clause 29 of the Bill be amended in paragraph (a) by deleting the words “spousal rights over matrimonial property” and substituting therefor the words “interest of spouses in actual occupation of the land or home, during and on termination of marriage”

Madam Temporary Deputy Chairlady, protection of spousal rights should not only be restricted to matrimonial home as defined in the land law, except for the matrimonial home in which the other spouse and the family resides. It would be difficult for third parties to ascertain whether the premise is a matrimonial property, especially when the family does not reside there.

Madam Temporary Deputy Chairlady, can I just say that when we sat down to look at this amendment, we invited the Committee for Implementation of the Constitution (CIC) just to make sure that we were on the right track. We also invited the Law Reform Commission and other bodies. Given the sentiments expressed and the level of articulation, I beg to withdraw the amendment.
