This Part vests all petroleum existing in its natural condition in the national Government, which will hold it in trust for the people of Kenya. Part VI deals with the very important question of the local content, which has been defined to mean the added value brought to the Kenyan economy from petroleum-related activities through systematic development of national capacity, capabilities and investment in developing and procuring locally available workforce, services and supplies for the sharing of accruing benefits. The part obligates all contractors to pay all the relevant fees and levies as may be prescribed in the petroleum agreement and any other relevant legislation. The part further provides for sharing of petroleum revenues and the establishment of a Sovereign Wealth Fund to provide endowments to support development for the benefit of future generations and to enhance the development of Kenya’s infrastructure, amongst other purposes. The part requires all contractors to comply with all environmental, health safety and maritime laws in upstream petroleum operations. The part prohibits the venting and the flaring of oil and natural gas except with the authorisation of the Authority and the national Government agency responsible for environment during production and testing for emergency reasons.

This part also establishes a disaster preparedness, prevention and management unit under the Ministry to coordinate response to accidents, disasters and other emergencies with relevant Ministries and agencies.
