  • 28 Apr 2016 in National Assembly: Hon. Temporary Deputy Chairlady, the intent of this amendment is good but if you look at the marginal note--- This is on the Cabinet Secretary granting geothermal resources licence. This is big business. I have no problem at all with the Committee Chair giving aggrieved persons access to appeal their cases to the High Court, but why do you limit the time or period for the High Court? You know how our court system works. It is clogged. These are commercial disputes and are rarely given priority. Why then would you limit them to 90 days? The implication of this ... view

  • 28 Apr 2016 in National Assembly: Where we got it wrong was to make power supply a commercial entity. In most countries that intend to develop, power supply is a social service. Everybody needs power, just like now everybody needs water. This House appropriates public expenditure. We should find a way to help. Every year, the directors of Kenya Power happily announce that they have made billions of shillings in profits. They do not tell you the pain that the people of Kenya are going through to The electronic version of the Official Hansard Report is for information purposesonly. A certified version of this Report can ... view

  • 28 Apr 2016 in National Assembly: I support. I am seconding Hon. Nassir’s amendment. We have done this with a human heart. For example, we are saying that if there was a cyclone which brings down the power line or if somebody is careless in driving their car and they knock down a power line, then Kenya Power cannot pay you. view

  • 28 Apr 2016 in National Assembly: Hon. Temporary Deputy Chairlady, I want to second. What we need to do is to give the aggrieved persons enough time to be able to exhaust the appeal mechanisms. We are talking about licences here. If we were talking about a contract, then it would be easy to put a filing fee of, say, a percentage like we did in the procurement law. The amendment is just talking about a licence. It is good because it widens the period within which the aggrieved person can be heard. I support. view
  • 28 Apr 2016 in National Assembly: No, Hon. Duale interfered when I was contributing. I had not finished. view
  • 28 Apr 2016 in National Assembly: Hon. Temporary Deputy Chairlady, the truth of the matter is that Hon. Nassir’s further amendment actually dilutes the intention of the amendment that he has in the new Article 193A. But we agreed to reach a middle ground so that we do not shield ourselves from reality in our country. There are many times when people driving carelessly knock down power lines. You cannot hold the power company accountable for that. There are times when cyclones bring down power lines. You cannot hold the power company accountable for that. There are times when we have insurrection in the country, people ... view
