But I have not seen the rules of the County Assemblies themselves. I hope that in those same rules, it is provided that the Senators may attend the County Assembly proceedings and also a Committee of the County Assembly proceedings. Mr. Speaker, Sir, I ask for your guidance. Reading the law as it is, it says “shall” and not “may”, giving no discretion on the part of the returning officer to cross-out the name of the candidate. We do not want to go into an election where there will be more spoilt votes than the votes cast. May I ask you to give direction so that the ballots represent the true position of the law? Thank you.

Mr. Temporary Deputy Speaker, Sir, this amendment has been necessitated because I think there was an earlier provision that this would be a provisional identity card popularly known as a waiting card but it was brought to our attention after consultation with the Deputy Leader of Government Business that this is definitely not a provisional identity card. It is actually an acknowledgment of registration. So, we have called it that instead of a provisional identity card. 34 Thursday, 13th December, 2012(P) in about three months to be able to obtain the identity card so that we do not block them out but we give them an opportunity to vote. If by that time they will not have gotten the identity card, then unfortunately they may not be able to vote but we hope that everybody who had registered will probably have an identification card on the voting day.

Mr. Temporary Deputy Speaker, Sir, I have shown the Member for Keiyo South the answer that I have and he was of the view that I should break down the constituencies into counties to give a clearer picture. We have just put them in terms of constituencies. I told him that that is something we can do. So, I can come back on Tuesday afternoon and give a proper answer.
