The Committee looked at this clause and the persons eligible to receive legal aid and services. Those persons must be indigent in our society. They must also be residents in Kenya. In cleaning up the particular section so that the limited resources can go to those who need them, the Committee looked at the groups which are eligible to legal aid and services. It has proposed deletions of some of the persons who are covered because resources might not be sufficient to extend the service to certain categories, including refugees. The law also seeks to provide that they apply in writing and remove unnecessary pre-conditions for granting of legal aid to eligible persons. Once the categories covered are identified, there are no conditions to their getting legal aid services. So, those are the proposals that the Committee has in Clause 36.
