Thank you, hon. Speaker, for giving me the opportunity to add my voice to what my colleagues have already said. In fact, Kenya is at cross roads, and the problem that we are facing at the moment is created by activists who have taken over the running of this country. When you look at these orders, which I will very comfortably say are unconstitutional, the same are given by people who were acting in a populist and The electronic version of the Official Hansard Report is for information purposesonly. What is happening is that our brothers, the governors themselves, have decided that they are the representatives of the people alone, and that we sit here and appropriate finances to assist our people and they use it for their selfish ends, and it does not benefit their people and our people at that. You cannot obey an unconstitutional order because if you do so, you are perpetuating unconstitutional behaviour. When you see the Chief Justice of this country constituting a bench on a Saturday, what does it tell you? It tells you that there is collusion with the people who ...

All that we can tell the court is that they are creating a gridlock in this country. The other day, we said that the Judicial Service Commission should not act, but they proceeded to act when they were not supposed to act and passed names of judges to the President. This is the same President we are saying should not constitute a commission to question them. They are causing a gridlock which will resonate for years to come. I am urging them to respect separation of powers, and let the Senate do its job. We are saying that we shall ...

The thing that they should understand is that we are here because of our people and not for anybody else. These pretenders to the throne, the so-called paper kings, who are the governors, should not benefit from the corruption cartels that are in place in their counties. So, I wish to join my colleagues to say that the orders given by the activist judges in the Judiciary should be disregarded because they are null and void, as hon. Kaluma has said. They are null and void. It is just a decision on paper; it is not hinged on any constitutional ...

Hon. Speaker, mine will be very brief. In fact, I would like to say that what transpired yesterday was a great embarrassment and nobody won. This is because when you defeat a Motion of extension of time to debate things that are important to this nation, I believe nobody won. I just heard hon. Chachu Ganya asking us to create some time to discuss insecurity in the country and it is all over the place. I think we should use our time in a better way. However, I would like to congratulate the CORD side for what happened. I believe ...

Thank you, hon. Temporary Deputy Chairman. I would also like to voice my objection to this schedule. This is because let us be practical. The courts have the discretion to decide compensation on damages to victims. This can affect us and the moment we just do things for the sake of a few people - that is the insurance companies - it becomes very dangerous. I look at this law as a lawyer and I believe it was done by the insurance companies. We should not fall into their trap. We should think about the bigger population of this country. ...

Thank you, hon. Temporary Deputy Chairman. In fact, to understand this issue, you must come from a place where there is wildlife because these communities have sacrificed a lot. They have sacrificed their land, lives, properties and everything else so that we can have this heritage. I believe that the suggestion or the proposals made on the further amendment by hon. Ntutu are reasonable. I believe that if you are going to give somebody Kshs5 million, it is good. I believe Kshs3 million for permanent disability is good because that person is as good as dead anyway. You cannot put ...

Hon. Temporary Deputy Chairman, I just want to make a few clarifications. One of them is that somebody talked about self-defence. This is provided for under Section 65, which states that it shall not be unlawful for any person to kill a wild animal in defence of himself or any other person, if the killing is absolutely necessary. So, if in the process of defending yourself you kill a wild animal, it is justified. The other issue is that we have seen our wildlife being disseminated by foreigners. We are now being told that our wild animals are being used ...

Hon. Temporary Deputy Chairman, I also wish to support the amendment. In fact, there was an oversight by whoever had prepared the Bill because with the stroke of a pen he actually took away trust land and converted it into national parks. They almost did it to us but thank God the Chair and the Committee realized that mistake and corrected it. So, I urge the Members to support the amendment. Thank you.
