On my behalf, that of the people of Kathiani and of my party the Wiper Democratic Movement (WDM-K), I stand to eulogise a great leader. He touched all of us in many ways. If you notice, the House has for the first time in a long time achieved the two-thirds majority. That means this was a person who touched all of us. He touched me, having worked very closely with my late grandfather Gen. Jackson Kimeu Mulinge as his Chief of General Staff and also as a minister in his Government. May his soul rest in eternal peace. Thank you.

Thank you, Hon. Speaker, for this opportunity. The National Treasury is actually like an engine in the running of Government because without funds you cannot do anything. So, it is imperative that they get organised. You have seen in the recent past that the National Treasury has put this country in a very bad place. We have a huge debt that goes against what this House has proposed. There are these arbitrary changes in the budgets. seven days. That is an important proposal. If you do not set timelines, some money remains uncommitted. That is the money in respect of which they later on propose changes. I am also happy about the proposal that there should be no budget reduction in respect of the Judiciary, the Parliamentary Service Commission and State Departments before such action gets approval of this House in the form of an approved Supplementary Budget. With those few remarks, I would like to thank the Committee for a job well done.

Thank you, Hon. Temporary Deputy Speaker for this opportunity. I was surprised when my colleague mentioned that I did not know he had spoken. Then he asked for the list of those who have spoken to be presented. Surely, everyone who has spoken already knows that the Standing Orders prohibit anyone from contributing to the same Motion twice. This is a House of honour and I doubt any Member would attempt to do that.

I rise to support the Equalisation Fund Bill (National Assembly Bill No.43 of 2019) brought to this House by Hon. Kamket. First, I would like to congratulate my colleague, Hon. Kamket, for doing a great job of coming up with a Bill like this. It will help to ensure that the funds that are supposed to be given for the support of marginalised communities are distributed in an orderly manner. I have seen some county governments constructing boreholes without community involvement. There is no project committee on the ground. They construct boreholes, install solar panels for generating power and leave them. Within two to three weeks, all those things are vandalised and stolen because the community does not see the project as belonging to them. So, when you have local community equalisation fund committees, they will help the people to accept and make the projects part of them. It will also make us conform to Article 10 of the Constitution on public participation. That will, therefore, make the projects viable. ...

The Committee on Delegated Legislation is guided by the Statutory Instruments Act which is very clear about the kind of things we are supposed to look for. In consultation with the Klynveld Peat Marwick Goerdeler (KPMG), Kenya Revenue Authority (KRA) and the National Treasury, we realised that the purpose behind this Regulation is positive. formulae used to calculate the Value Added Tax (VAT) refund. The current formulae disadvantage exporters of taxable goods. They are not able to fully recover their input VAT. Basically, it is something that should be supported because it helps those exporters of taxable goods.

For a country to grow, we need to encourage exporters. It makes sense. We considered this Regulation against the principal Regulations. We found that they were in conformity. We checked the timelines and found that they were submitted within the statutory timelines which are contemplated. There was adequate public participation. We realised that they talked to the Institute of Certified Public Accountants of Kenya (ICPAK), Kenya Association of Manufacturers (KAM) and the Private Sector Alliance. We felt that there was enough public participation. These Regulations do not require a statutory impact statement.
