  • 20 Apr 2011 in National Assembly: Thank you, Madam Temporary Deputy Speaker, for giving me this opportunity to respond to this Motion which is before the House. I take note that most of the Members who spoke on this Motion have supported it. I think the most instructive information that we have is that this has been over a period of time. As the hon. Mover reminded us, up to 1980, there was some scheme of service which was in place and, therefore, those who were there before that time, did qualify for pension at the end of their service term. view
  • 20 Apr 2011 in National Assembly: However, as the institutions started improving under Legal Notice No.262 on Board of Governors (BOG) and Non-Teaching Staff Regulations in 1993 and, of course, the Education Act Cap. 211, BoGs and Parents Teachers Associations (PTAs) were given the mandate to manage the institutions, to engage, to promote and demote or terminate the services of any employees in that area. view
  • 20 Apr 2011 in National Assembly: Therefore, in simple terms, as the law stands today, the Board of Governors (BoGs) and the Parents-Teachers Association (PTAs) are the only legal entities that have the power to appoint suitable semi-professionals and subordinate non-teaching staff on conditions and terms that are determined only by BoGs and PTAs. As a Ministry, we have listened very carefully and we have seen some of the loopholes that are there. We are cognizant of the fact that the law as it stands today requires substantive amendment. Therefore, the Motion before the House cannot amend the existing law. It was because of this and ... view
  • 20 Apr 2011 in National Assembly: Madam Temporary Deputy Speaker, I would like to say that we are taking into account the views that you have expressed. These views will be transmitted to the current task force which is in force and which is realigning all the policies of the Ministry of Education vis-Ă -vis the new Constitution. One of such policy is to look at the Education view
  • 20 Apr 2011 in National Assembly: On a point of information, Mr. Temporary Deputy Speaker, Sir. Just to inform the hon. Member, those were imprests and the matter is very active in court. Therefore, it would be wrong to discuss it further than that. There are more and more who have been taken to court. view
  • 13 Apr 2011 in National Assembly: Mr. Speaker, Sir, we have debated extensively the Supplementary Estimates. There were several concerns which were raised and they have now all been captured in the Appropriations Bill which is before this House. I would, therefore, move that the mover be called upon to reply so that we can expeditiously dispose of this matter. view
  • 13 Apr 2011 in National Assembly: On a point of order, Mr. Speaker, Sir. Earlier on I had indicated that the mood of the House is that this is an Appropriation Bill. All issues were discussed during debate on the Supplementary Estimates Motion. So, would I be in order to ask that the Mover be now called upon to reply? view
  • 12 Apr 2011 in National Assembly: Mr. Speaker, Sir, I am quite sure that he has not got the answer. Earlier on, this afternoon, he reported to you that he was going to look for a satisfactory answer to the Question. Now that he is unavailable, it means he has not got the satisfactory answer. So, I will endeavour to inform him that a satisfactory answer is required. I do not know when you would like to direct that he comes with the answer, so that we can communicate with him appropriately. view
  • 12 Apr 2011 in National Assembly: Mr. Speaker, Sir, I wish to respond to a request for a Ministerial Statement by the Member of Parliament for Migori, hon. John Pesa, on the state of affairs at Teachers Service Commission (TSC). view
  • 12 Apr 2011 in National Assembly: First, I would like to agree with the hon. Member on the first query he raised in his request as to whether there was a go-slow at the TSC. I want to confirm that there was a go-slow strike by staff members at the TSC between Wednesday, 6th April, 2011 and Thursday, 7th April, 2011. Secondly, the hon. Member sought to know why there was such a go-slow strike, and I would like to respond that the go-slow was caused by the following factors:- (a) The decision by the top management of TSC to promote and increase the salaries of ... view
