  • 17 Oct 2024 in Senate: Mr. Speaker, Sir, when I put this question yesterday, seeking clarification from the defense team, they chose to make snide remarks about appointments that have been made recently of members of my party, Orange Democratic Movement (ODM). I have agonised about some of the things that the Deputy President has said. In fact, in my entire time as an elected leader, I have met the Deputy President once and this is the second occasion when he was in the House. Honestly, both of them were very sad events. The first one was a funeral and these proceedings can also be ... view
  • 17 Oct 2024 in Senate: agonized over what to do with an agreement that ousts the mandate of constitutional bodies. For instance, you are told that in the agreement, positions that essentially are supposed to be available to all Kenyans through advertisement by the Public Service Commission (PSC), like permanent secretaries, have already been dished out. What am I supposed to do with a contract that ousts the mandate of the PSC, a constitutional body? What am I supposed to do with a contract that ousts the mandate of this House, for instance, to vote for the person who sits in the chair that you ... view
  • 16 Oct 2024 in Senate: Mr. Speaker, Sir, unfortunately I hear that the Bible verses have been exhausted. However, I seek a clarification from my friend, Counsel Macharia, who has helped me to understand complex legal issues before. Counsel, because you have presented a coalition agreement to explain this issue of shareholding, where does that coalition agreement leave members of political parties that are not signatories to the Kenya Kwanzaa agreements? That is the first question I would want clarification to. The electronic version of the Senate Hansard Report is for information purposesonly. A certified version of this Report can be obtained from the Director, ... view
  • 16 Oct 2024 in Senate: Number two, what would be the place of a coalition agreement that is manifestly unconstitutional or illegal? The page that you referred us to includes securing positions that are supposed to be competitively filled, for instance, the position of Principal Secretaries (PS). Is it your position that in fact these advertisements that we see in the newspapers are just a charade to cover up things that have already been concluded in coalition agreements such as the Kenya-Kwanza agreement that you have exhibited here? view
  • 15 Oct 2024 in Senate: Mr. Speaker, Sir, I increasingly grow proud of our Standing Committee on Finance and Budget. view
  • 15 Oct 2024 in Senate: The Members need to keep calm because I do not think they will be very happy with what is about to come next. I was a bit worried at the beginning of the term of this Parliament that we had departed from our constitutional duty to be the protectors of counties and their governments as stipulated under Article 96 of the Constitution. Hon. Speaker, let me borrow the words of the Minority Whip that, in fact, this Senate must at every single opportunity stand up to protect devolution and devolved units. That every step that has been made in advancing ... view
  • 15 Oct 2024 in Senate: Mr. Speaker, Sir, on behalf of the CHPs of Nairobi, I will vote to oppose any reduction in the monies that was allocated for them. The Road Maintenance Levy Fund (RMLF) reduction of Kshs10.5 billion is, as the Committee rightfully notes, a contravention of the Constitution. This is because if under Schedule 4, a role is defined to be a county role, then it follows the constitutional principle requires that, that role be financed. For you to remove the entire RMLF allocation for county roles under Schedule 4 is a contravention of the Constitution. Mr. Speaker, Sir, in the Financial ... view
  • 15 Oct 2024 in Senate: Mr. Speaker, Sir, protect me from the Senate Majority Leader. view
  • 15 Oct 2024 in Senate: Mr. Speaker, Sir, I am surprised the Senator for Nandi wants to insert himself in the communications between my mother and I. Therefore, we as a House must in totality take the position that there is absolutely no justification for these things. As I said even during the debate on the Division of Revenue, the practice has always been that any shortfall in revenue must be borne by the national Government. These programmes are critical and if you are going to tell 22,000 CHPs that they are no longer going to earn the Kshs5,000 they are supposed to earn, it ... view
  • 14 Oct 2024 in Senate: Mr. Speaker, Sir, from the onset, I am extremely disappointed in terms of the sort of filing that has been done by the governor's team. Perhaps at the inception of these hearings, all the parties need to introduce us to the documents they have filed. I say this with the greatest respect because the hon. Katwa Kigen is a litigation lawyer of no mean repute. However, I must say that this is below standard. First, introduce us to the documents you have filed. Indicate what colours are on your document, I am being told by the ladies that the colour ... view
