  • 1 Feb 2017 in National Assembly: This is very important because of the experience we have had in the recent past when the Chief Justice and Deputy Chief Justice were retiring. There was a challenge on the age of retirement of the Deputy Chief Justice. It became very difficult on how we were going to handle that position. But, this Bill will address that position and we should even go further and make sure that even the appointment of the Chief Justice should be based on seniority in the Judiciary. view
  • 1 Feb 2017 in National Assembly: I now address myself also to the proposed amendment on the Persons with Disabilities Act. There is a comprehensive proposed amendment on that Act. I do not know why they want to bring it in here now in the Statute Law (Miscellaneous Amendment) Bill. This is a piecemeal amendment. We had proposed a comprehensive amendment to the Act, but that Bill is yet to come to the Floor of this House. I believe this is good because we have had issues where, for example, when the former Vice-President and former Prime Minister retired. We started playing politics with it. First, looking at Section 8, it talks about the independence of the office of the coroner and emphasises that nobody can influence the decisions or performance of the functions of this office. This is very important because we need to allow institutions to function and not to be micromanaged by somebody else who is not even in the position to make that decision. The issue of the secretariat must be seriously looked into because it is the cause. I think of the Commission performing. The Commission is supposed to do its work but the secretariat frustrates them and makes them not to perform.
