Jude Njomo seems very laudable and timely, I have a few concerns and because of those concerns, I request him to either withdraw it or redraft the particular amendment to avoid three critical issues. One is a case of over-regulation and generally stifling decision-making in banks. Specifically, the problem that SMEs in this country have in terms of accessing loans is not unavailability of funds. You have always ruled, time and again, that we can raise the issue of constitutionality at any given time during any debate. The Constitution contemplates that anybody appointed or proposed to be appointed to any position in public service must meet the qualifications set out in an Act of Parliament, Constitution or any other law or regulations in force. The Salaries and Remuneration Commission (SRC) Act No. 10 of 2011, under Section 5, is categorically clear on the qualification of somebody to be appointed as a chairperson and as a member. ... view
  • 30 Aug 2018 in National Assembly: Out of the nominees who have been proposed for appointment, one does not meet the requirements of Section 5 of the respective Act. So, the question is: Are we being forced to approve a matter that is unconstitutional? I am talking about the third nominee said to be nominated by the Parliamentary Service Commission, one Halima Abdille Mohammed. If you look at the Committee Report on Page 29 all the way to Page 32, it is very clear.   • 30 Aug 2018 in National Assembly: Hon. Speaker, I was a lecturer at the University of Nairobi before I came here. Basic calculation tells me that ordinarily students graduate either at the age of 22 or 23. So, generally, she ought to have graduated from the university in 2011 with a Bachelor’s degree in Education (Science) from Kenyatta University. Basic calculation tells me that 2011 to 2018 does not meet the requirements of 10 years of distinguished career in the relevant field. Are we being taken down a route of illegality or what are we looking at here? Hon. Speaker, we need your guidance. Thank you. view

  • 29 Aug 2018 in National Assembly: One, we have not even agreed that we are creating the National Housing Development Fund. Why would you make an amendment for something that does not exist? We should hold our horses. I believe that there is a mechanism which can allow us to come back and make the necessary amendments, once we agree with Clauses 65 and 68 that we are approving. view
  • 29 Aug 2018 in National Assembly: Secondly, honestly speaking, there is a technical procedure of creating a Fund. National Housing Development Fund needs to be preceded by an actuarial study to ascertain the demand and requirement and how you operate the Fund. I believe that the amendments by the Leader of the Majority Party are premature and unconceived. We can come back to them at the appropriate time. view
