Even this House, as you are aware, has been gagged and told not to debate this or that because we will be in contempt of court. So, this Bill comes forth to make it clear to the Kenyan people, this House and to you, Hon. Speaker and Members of this House, so that nobody fears when you are supposed to make a comment on issues because you will have been told the aspects which constitute criminal or civil contempt. view
  • 17 Nov 2016 in National Assembly: Section 8 says: ―Proceedings for contempt of court shall not be instituted except by or with the consent of the Director of Public Prosecutions or on a motion of a court having jurisdiction to deal with criminal contempt of court.‖ This is a good departure from what used to happen. Before proceedings of criminal contempt are instituted, the Director of Public Prosecutions will have satisfied himself that, that can constitute criminal contempt of court in criminal cases. view
