Hon. Speaker, I want you to provide guidance. That is because it is public knowledge that, that particular notice has been suspended legally as it stands in this very House. However, it is public knowledge that no one is allowed to continue the way they have always been using their trucks and they are being forced to use the Standard Gauge Railway (SGR). So, Hon. Speaker, I would like you to give a ruling on this matter with your discretion. In the event that, that is the case on the ground, and we can prove it, what action should be ...

Hon. Deputy Speaker, pursuant to Standing Order No.43, I requested for a Statement on Tuesday, 6th August 2019 regarding transportation of cargo based on a Government directive to all public agencies and departments that transportation of all containerised cargo from Mombasa be through the Standard Gauge Railway (SGR). Following this request, you directed the Departmental Committee on Transport, Public Works and Housing to hold a meeting with the Cabinet Secretary for Transport, Infrastructure, Housing and Urban Development on Thursday, 8th August 2019 at 10.00 a.m. to obtain his submissions on the matter. During the Sitting of the House on Thursday ...

Hon. Deputy Speaker, with due respect, I request you to rule that the Leader of the Majority Party and the Chair of the Budget and Appropriations Committee (BAC) come out clear. I will want you to give a ruling on this one. The Chair of BAC talked. He tried very hard to refrain himself from mentioning names of people. Eventually, his tongue slipped. He eventually mentioned my Governor. I want your ruling to declare that he is totally out of order, and that mentioning someone who cannot defend himself in this House is not based on the traditions of this ...

My apologies, Hon. Speaker. It was not a point of order. I wish to comment on the issue of Disco Matangas because I saw many Members had started agitating. Two things are important. First, we should respect the cultures of others. More importantly, we should respect our own culture. What initially started as a rightful way for the tribes to give a befitting send-off has now been tarnished. I am aware that a number of leaders from those areas have claimed that one of the major reasons why there are early childhood pregnancies is because of Disco Matangas . The ...

Thank you, Hon. Speaker. The mood of the whole House is that this is something that is totally wrong. It is ungodly and unconstitutional. The ruling that you need to give is whether it is in order for this House to discuss a matter that is unconstitutional. The Petition that is being brought forward simply says that we want to find out the person funding these people. The question is whether this House is at liberty to go ahead and start discussing issues that are unconstitutional. You will need to give a judgment on that issue, so that we can ...

Sometime last year, all Government agencies and departments were directed, through a circular from the Head of Public Service, to transport all their cargo from Mombasa using the SGR. There now seems to be a push by the Government to have all cargo received at the Port of Mombasa transported on the SGR. This is of concern as it is currently unclear how much railway levy is being charged per tonne of goods transported. There are fears that the final cost of goods will be affected and road transport companies will suffer.
