Mr. Deputy Speaker, Sir, once we process the cheque and give it to the owner, it is not our duty to follow whether it will be cashed or not. So, as much as we are concerned as the Government, we paid and I have indicated the cheque number. He received it and signed that he had received the cheque. So, what happened to the cheque is not our business.

Mr. Deputy Speaker, Sir, as you are all aware the National Hospital Insurance Fund became a parastatal through an Act of Parliament in 1998. Subsequently, the Board of Management embarked on the organization of staff, rationalization and right-sizing. That exercise led to the abolition of some officers. They could not trace the file of the officer because he was transferred from the Ministry of Public Health to the NHIF and then there was subsequent re-organization of the parastatal. However, the Ministry made a skeleton file to make this payment. That is why it was done.

Mr. Deputy Speaker, Sir, I think I made myself very clear. We forwarded the documents to the Treasury. Personally, I talked to the Accounts Department at the Treasury today and they told me that they are only waiting for the documentation from a Mr. Olweny.

Mr. Speaker, Sir, I rise to support this amendment. The framework of the Constitution is not really to give the entire details of the Commission we are creating. It is important and enough just to state that we create the National Land Commission. The functions of that Commission ought to be left to an Act of Parliament. If you look at the functions stipulated under the proposed Constitution, you will find that they fly in the face of the principles and objectives given for devolution in the same draft. Indeed, there is need to harmonise our land ownership system. The multiplicity of laws that govern land have contributed greatly to the ills that go with the land ownership in this country. I will touch on a particular statute that has been used to marginalise our people. This is the Land Title Act. This was referred to as the âLand Title Ordinanceâ before Independence. The Minister has taken us through what he has achieved in the last financial year, despite the meagre resources allocated to the Ministry.
