  • 22 Sep 2021 in National Assembly: Hon. Speaker, you are aware that the Ministry of Foreign Affairs has Trade Attaches in each and every Embassy of our Republic abroad. Indeed, on some of the data they claim they could not get, including data on volume of trade transacted by Kenyans in China and by Chinese in Kenya, I find it dissatisfying because it is data that is easily available. I raised this request on19th August, 2021. view
  • 22 Sep 2021 in National Assembly: Hon. Speaker, I am aware that the Committee did not meet with the Ministry of Foreign Affairs yesterday. Therefore, to purport to be hiding behind Kenya Revenue Authority (KRA) is, indeed, unsatisfactory. It points to the key things that we should address. I expected the Chairperson and the Committee together with the Ministry to address the hurdles stopping Kenyan businesspeople from accessing the Chinese market and travelling to China. Once the Chair tables the Statement, Members will be able to see that there is a contention that this is the way it is around the world. The Committee oversees the ... view
  • 22 Sep 2021 in National Assembly: Thank you, Hon. Speaker. I am well guided. I want to mention before the House that your statement is true: the Chinese population compared to ours, in relative terms, might be a justifiable cause. However, I expect the Chairman and the Committee to give us the number of Kenyans who have sought to travel to China but have been unable to. I would like to seek the reasons why our Ministry of Foreign Affairs is not exercising that policy of reciprocity in our engagement with the Chinese people. This is because our people are suffering. You are also aware that ... view
  • 22 Sep 2021 in National Assembly: State and as the people's representatives, we must pick on issues that touch on our people and not the Chinese people. I will be happy to appear before the Committee. I was shocked this morning when the Clerk called me and communicated that they had received a written response last night. I was surprised that the Chairman had not invited me. This is because we have data of Kenyans who sought to travel but have been unable to. It is good and I appreciate that we now have the Sinopharm vaccine from the People's Republic of China. It is good ... view
  • 21 Sep 2021 in National Assembly: Thank you, Hon. Speaker. I rise to also support the Petition by Hon. Mule and the one by the other petitioners, although I do not want to join in the chorus of giving excuses for ourselves. First, we must begin by asking ourselves as a House whether it is not time to amend Article 115(4) of the Constitution that gives the President the powers to legislate through the backdoor. You remember it is on record in the Hansard that this House voted to defeat the infamous 8 per cent and 16 per cent VAT on fuel. However, through veto powers ... view
  • 1 Sep 2021 in National Assembly: Thank you, Hon. Speaker, for giving me the opportunity to add my words on this matter. Let me also begin by thanking Hon. Duale for raising the issue because, as he indicated, it is quite a substantive matter that needs your very considered guidance. I identify myself more with what has been said by the Member for Ugenya that, indeed, what the court was doing was creating a clear distinction between the repeal of the Constitution and amendments to the Constitution. What we are involved in, that is, the legislative Bills before the House, are actually amendments to the Constitution ... view
  • 1 Sep 2021 in National Assembly: the matter still have the right and opportunity to canvas the issues that were before the High Court and the Court of Appeal in the Supreme Court. In my own reading and understanding of that judgement, especially on the doctrine that has been raised on the basic structure, although I am not a lawyer, just like Hon. Mbadi who is an accountant and an intelligent Kenyan, has said, we are able to read and decipher what basically forms the basic structure of a constitution or even a building like this one. Those are things that hold even a structure like ... view

  • 1 Sep 2021 in National Assembly: Thank you, Hon. Speaker, I rise under Standing Order No. 83 to raise a matter relating to Standing Order No. 218 which provides that a Committee should be limited to its mandate unless a matter has been referred to it by the House on a Motion, or by the Speaker, or by way of a Statement or Question sought in the House. Standing Order No. 195 provides for attendance of non-members. You are aware that by practice of this House, sittings of the House take priority over any sittings of a Committee and this being a Special Sitting, it takes ... view
  • 1 Sep 2021 in National Assembly: previously guided and in line with our Standing Orders, a Committee can only meet with your permission while the House is sitting. Hon. Speaker, I want to raise this issue because I am aware that the Departmental Committee on Administration and National Security is currently holding a meeting. You have made many considered rulings before. In particular, I remember the one you made on 10th June 2014 on the issue of the recall of Cabinet Secretaries (CSs) and how Committees of this House should go about the procedure of recalling or impeaching a CS. In that ruling, there was a ... view
