Hon. Temporary Deputy Chairman, I beg to move: THAT, clause 31 of the Bill be amended− (c) in sub-clause (2) by deleting the words “in person”; (d) by deleting sub-clause (6). This amendment is for the purpose of correcting some grammatical error since the Commission is not a person. So, it is meant to address that.

Hon. Temporary Deputy Chairman, on Clause 31(b), Article 234(5) of the Constitution gives the Commission the power to delegate any of its functions or powers. Therefore, it is not necessary to re-state it and it is meant to address that.

“(c) the transfer shall not be arbitrary” Both (a) and (b) are meant to address the issue of numbering the paragraphs. So, that is the rationale.

Hon. Temporary Deputy Chairman, if you look at the Bill, it is meant to address issues of numbering. If you look at the proviso, it is already provided for in the Bill. Most of what we are doing here is numbering. The provision is actually in the Bill.

The Commission shall prescribe the terms and conditions for employment of casual employees within the public service.” This amendment seeks to ensure that the Commission shall have the powers to make regulations for the terms and conditions of employment of casual employees within the public service.
