  • 13 Nov 2019 in Senate: who are controlling the economy and the industries to date. In fact, they are called petite bourgeoisie. Hon. Wanjala used to call those people petite bourgeoisie when he was teaching us Land Law. I know that most people have read the book, ‘How Europe Underdeveloped Africa’ by Walter Rodney. That book came to mind when I was in New York last month where I saw very tall buildings. I wondered how those people got such mammoth wealth to develop such big cities. Those people stole our wealth, minerals and took our strong men though that does not mean that we ... view

  • 13 Nov 2019 in Senate: Thank you, Mr. Speaker, Sir. I am guided by Senior Counsel on the same and I will do much digging. The point he has supported is that we should not blame the ‘White Man’ per se as it were. He has confirmed that, indeed, the problem is those senior people, especially those in Cabinet. The problem is from within not without. I support. view

  • 12 Nov 2019 in Senate: Thank you, Mr. Speaker, Sir, for giving me this opportunity. I will be very brief. I just walked in when this important debate was going on. I want to support Sen. (Dr.) Ali of Wajir for this timely Statement, which has also been brought severally by different Senators including myself. We can sit here and discuss but one thing is critical, that this problem cannot be wished away. However, I have a solution, a cure punch, that as a Member who sits in the Committee of Finance and Budget, I think we should find a solution where these outstanding county ... view
  • 7 Nov 2019 in Senate: Thank you, Mr. Speaker, Sir, for giving me this opportunity to ably support this Statement by Sen. Cherargei, of Nandi County. It is very important and timely. The issue of independence of the Judiciary, which my learned friend, Sen. Kang‟ata, seems not to have forgotten, is well espoused in Article 160 of the Constitution of the Republic of Kenya, 2010. The independence of the Judiciary, well espoused in that Article, clearly gives five limbs. This is the scenario where, I think, Sen. Cherargei derived his thoughts. It is espoused strongly that the authority of the Judiciary can only be exercised ... view
  • 7 Nov 2019 in Senate: Mr. Speaker, Sir, the Constitution further states that the Office of the Judge of a superior court shall not be abolished while there is a substantive order of the Office. This one gave the security of tenure, which had been eroded like we have been told by Sen. Orengo here and Sen. Wetangula. The issue of remuneration and benefits payable to the Judges shall not be a charge on the Consolidated Fund. Therefore, on matters finance, it is very clear that the remuneration and benefits payable to Judges cannot be varied to their disadvantage. Therefore, the Constitution insulates and fortifies ... view
  • 7 Nov 2019 in Senate: Finally, Mr. Speaker, Sir, it is also stipulated in the Constitution that a Judge or a member of the Judiciary is not liable on any action or suit in respect of anything done or meted to be done in good faith in the lawful performance of their judicial functions. What is happening in the country is that the Executive has tried many times, through action and deed, to emasculate or interfere with that independence. Therefore, any time the funds are reduced, we do not expect efficient management of justice. view
