On a point of order, Mr. Speaker, Sir. Is the Assistant Minister in order to mislead this House that in some of the years the Constituencies Development Fund (CDF) got more from the Treasury, while it is very clear under the Act that it is not less than 2.5 per cent? I was a Member of the previous Committee and we negotiated for 2.5 per cent. Is he in order to mislead the House?

Mr. Speaker, Sir, as I said earlier, I was a Member of the CDF Committee. In Financial Year 2006/2007, we were allocated 2.5 per cent, and we sat with the Ministry of Finance when we realised that it had collected more money than it had estimated. The Treasury released funds to the CDF to fill the gap. Could he assure this House that if there is going to be a gap, he is going to release more funds?

Mr. Speaker, Sir, Masinga Dam, which is the biggest reservoir, is located in my district. The towns near the dam do not have power, particularly Masinga Constituency, Yatta, parts of Mavoloni and Ndalani. When Kenya Power and Lighting Company was putting the high voltage cables to Nairobi, they never compensated those farmers. To date they have not been compensated and they do not have power. You ruled that this matter must be brought to your office in advance to make a ruling on whether or not it touched on the rule of subjudice . Therefore, I am just reminding you about your earlier ruling so that hon. Ministers do not ambush the Chair and the House by saying the matter is before the court and, therefore, subject to the rule of sub judice .

On a point of order, Mr. Temporary Deputy Speaker, Sir. Is the Minister in order to avoid answering the question, which I will repeat? It is obvious that, in the region where I come from, Ukambani, there is always drought. Is he in order to avoid the question? The question was very simple. Why can he not plan, having in mind that there is always drought in most parts of this country and provide money for irrigation?
