Hon. Temporary Deputy Speaker, I stand on Standing Order Nos.47, 119 and 127. Standing Order No.47 (3) (1) states: “If the Speaker is of the opinion that any proposed Motion- (a) is one which infringes, or the debate on which is likely to infringe, any of these Standing Orders---” That Motion should not proceed. The debate on this Motion will infringe on the Standing Order. Standing Order No. 119 clearly states: “Every Bill that contains a provision limiting a right or fundamental freedom in terms of Article (24(2) of the Constitution shall contain separate and distinct provisions- (a) clearly expressing ...

I am canvassing sub-section (5). It says: “If for any reason, at the commencement of the Second Reading the report of the Committee has not been presented, the Committee concerned shall report progress” So far the Committee has not reported progress and that is our infringement of Standing Order. So, I believe this Bill should not be debated.

Thank you. I will deviate from what the other hon. Members have said. I think this petition is cheeky. It is cheeky because it is coming at a time when there is also something we fast- tracked yesterday about revamping the laws governing security. Somebody is trying to take advantage of the fear that Kenyans have due to the increased insecurity. In the process, he is trying to put everything upside down and inside out; this petition is one of the ways in which he intends to do this. mandate is it to replace that commissioner, so that there should have been quorum at the Commission? I have suspicion at the back of my mind that this petition is cheeky. It is going to run hand in hand with the Bill that was tabled yesterday on revamping the security mechanisms in the country and in the process, I think, there will be a move to replace many of these people with what I would call compliant subjects of the country. country has gone through a very trying period in terms of security. It has led to drastic measures being taken where people who should be highly placed have had to relinquish their positions of power in the security system hoping to rectify the security situation. We recognise that even if we appoint new people to those positions, if they do not have the tools to work, they might not deliver.

Hon. Speaker, however, it is very important to realize that at times like these we need a lot of sobriety in reviewing laws. If we review laws for expediency then we run the risk of making some very serious mistakes. So, I would suggest that one day is not enough publication period.
