Thank you, Hon. Temporary Deputy Speaker. Social protection is not just about disbursing money. It includes building communities, offering psychological support, building families and doing things that will create cohesion in the nation. Doing a mechanical job of taking money and handing it over to people is a misunderstanding of what social protection is. The Constitution gives Kenyans the right to social, economic and civil liberties as well as cultural rights. So, to effectuate social security right, we have to enhance the National Social Security Fund Act. To effectuate the right to healthcare, what we are discussing this afternoon, and ...

In fact, if you asked me, I would have proposed that these roles should be shared by the county governments because they now have roles that are dominantly social. I would imagine that they would be talking about having county governments helping the national Government on issues of healthcare and agriculture, as it has been put in the Constitution. I do not know what to say, but some of the legislative proposals that come to this House sometimes surprise me. That is why yesterday you heard Members here talking about VAT. The Bill was brought to this House, we passed ...

Hon. Speaker, if you allow me, because I know the next order is something really sensitive, I just wanted to raise a point under Standing Order No. 1 on Article 94 of the Constitution regarding the ongoing measures to combat COVID-19. This House in April last year, passed a number of Regulations to enable the Cabinet Secretary, Ministry of Health and that of the Ministry of Interior and Coordination of National Planning to enable them take measures to curb COVID-19. It is not more than 15 months since this happened. Our concern is, the almost weaponising of the room we ...

Finally, the High Court on the 17th of last month, made a finding that the orders be given by the various Cabinet Secretaries that is, the Cabinet Secretary in the Ministry of Health and that of the Ministry of Interior and Coordination of National Government, have weaponised this to the extent that some people are allowed to go on with their lives and activities without being disturbed but others are not being allowed these meetings. The court found that these orders that are being done especially without referring to this House under Article 94(5) and (6), are against Article 10 ...

Thank you so much, Hon. Speaker. I want to thank Hon. Duale for bringing such an important issue for your considered ruling. Remember on the day of voting on the BBI Bill in this House, I raised so many pertinent issues on which you made your considered ruling. I want to say that, where Hon. Mbadi and I come from, we say that when a mongoose catches the chicken, we chase the mongoose, but we also blame the chicken. What was it doing in the bushes where the mongoose is supposed to be? On this matter, we are dealing with ...

to touch the issues under Article 255 and you are going to do it through a popular initiative, you must do what was done before the 2010 Constitution came to be; whether you must put together a constituent assembly… If that is to be the case and if this House considers to be an important matter, then we just need to make a law, provide for how we will deal with the matters under Article 255. We cannot say that the courts are wrong in saying that there are some issues in the Constitution that are so deeply entrenched that ...

Thank you so much, Hon. Temporary Deputy Speaker. I rise to support this Bill which seeks to give the Central Bank of Kenya powers and the capacity to manage the fast-growing digital lending industry. As a Member of Parliament, nowadays when constituents ask you for help, they will most likely ask you to send them money to another number because the one that you have has a loan. It has fuliza or whatever they call it. It is so normal. In the village where I come from, there are The electronic version of the Official Hansard Report is for information ...

televisions that have been sold to citizens that only work if they make monthly payments. If they are not made, the televisions stop working. There are also power lamps that only switch on if you have paid the money. All those are forms of digital lending. The most important thing about lending that I believe the CBK will address through this Bill is the requirement for transparency on the terms and conditions attached to digital lending. Everybody has gone headstrong into digital borrowing. Almost everyone is now borrowing from all the platforms available in the country. They are easier to ...

industry . You go in, pay Kshs10,000 and leave with a pikipiki . You pay the rest through a platform. We have seen people harming themselves because they are unable to pay on time. The Government has interest and I hope the CBK will have interest in ensuring that Kenyans do not get so indebted that they run into mental turmoil. There are also requirements that when sharing information, the Credit Reference Bureau and any other credit reference sharing platforms must be regulated, so that information about individuals borrowing is not just out there. An individual borrows money from this ...
