As we sit today, the Committee notes that there are more than six cases going on in the courts. I have perused the Report and the nature of these cases because they are summarised for us there. The result of all of these cases is that the courts may actually find that the whole process from day one was a nullity. The courts have said so in their ruling. Number four, what about if some of the proposals in the promoters’ Bill have the effect of upsetting the Constitution? We are having a coup. Hon. Temporary Deputy Speaker, I respect Hon. Kiarie. However, what is before us is amending a Motion. Where did we start amending Bills using Motions? He has said what should happen anyway. In case the Economic Partnership Agreement (EPA) that we will approve or disapprove tonight is reviewed, it will be a new agreement. They must bring it back. We cannot say that we will bring it back.

Two, I sponsored the Kenya Trade Remedies Act in this Parliament. It is not part of his role to oversee how trade agreements are implemented. We will create a body using a Motion which is illegal. It is not done that way. Much as the amendments proposed are in good faith and are meant to make the processes work, the argument before us today has too many other bodies that oversee it apart from Parliament. So, we cannot appropriate only one institution. If you allow these amendments to go ahead, they will exactly be illegal because they will be nugatory. ...
