Mr. Speaker, Sir, I stand to seek Ministerial Statements on two issues. One from you and, possibly, the other one from the Prime Minister. Under Section 39 of the Kenya Constitution, any hon. Member missing sittings of the House for eight consecutive times automatically loses his or her seat in this House. I would like to know whether those provisions apply to the Office of the Attorney-General and, if they do, why the Attorney-General does not sit in this House to answer Questions that are addressed to his office! Mr. Speaker, Sir, I am glad that the Deputy Prime Minister does not appear to have listened to me. I asked whether the Government Spokesman, Dr. Mutua, has supervisory jurisdictions over Ministers who give Statements in this House. That is because last week, when the Prime Minister gave a Statement in this House and indicated that the former Minister for Finance had gone, Mr. Mutua purported to explain that to mean the Minister had not, in fact, gone, but had just stepped aside contrary to the provisions and the Statement given to this House by the hon. Mr. Deputy Speaker, Sir, the Assistant Minister is misleading this House when he says that certain roads fall under the purview of the District Roads Committees, when he knows that they depend on the Ministry for funding! Could the Assistant Minister tell us when he will allocate funds to the District Roads Board so that they can do those roads, rather than say that they fall under the purview of the District Roads Boards, which have no money?

Mr. Deputy Speaker, Sir, four or five weeks ago, a situation arose in this country that has very grave constitutional implications. The President and the Vice-President and Minister for Home Affairs were out of the country. To make matters worse, the Prime Minister and one of the Deputy Prime Ministers were also out of the country. Could the Leader of Government Business give a Ministerial Statement on why such a situation arose when there are such serious July 9, 2008 PARLIAMENTARY DEBATES 1707 constitutional implications on the Office of the President?

Mr. Speaker, Sir, you heard the Minister say that the reason why the tendering process has began is because the country has returned to normalcy. Is the Minister telling this House that the country has returned to normalcy when we know that there are several thousands of Internally Displaced Persons (IDPs) in various parts of the country? If that is so, should that tendering process not await the settlement of IDPs, so that the country can truly return to normalcy?

Thank you, Mr. Speaker, Sir. I wish to congratulate the Prime Minister for this very first Prime Ministerial Statement that he has made. The assurance that we have been given is that the Government is going to investigate this matter. As Mr. Okemo said, this matter is before a Parliamentary Committee which is yet to complete its work. On a point of order, Mr. Deputy Speaker, Sir. You are well aware, because you were on the Chair, that this House passed a Motion of censure against the Minister for Finance, with unanimous support of the House. Under those circumstances, is it in order that a Question be directed to the Ministry of Finance? Should this Question not be deferred until such a time when we have a Minister for Finance, whom this House has confidence in?
