As we speak, half of our country is affected by floods that have been occasioned by torrential rains which, in the case of Arid and Semi-Arid Lands (ASAL) region of this country, have come after three years of very severe drought. Because that Authority is not in place, that is partly the reason we find ourselves in a situation where there is a lot of water causing a lot of destruction. Our roads are destroyed, and most parts of this country are no longer passable. In my own constituency, we had to do air dropping of food in places where huge populations have been cut-off. It is important that authorities which are given privilege to consider delegated legislation adhere to provisions of our Constitution. Public participation is mandatory. We know that these regulations are enforceable. It is important to give people who will be affected by the regulations adequate opportunity to contribute towards their formulation. Adverts which are put in newspapers to call for memoranda should not be treated as an adequate form of soliciting inputs from the public for formulation of regulations. As the Chairman of the Departmental Committee on Administration and National Security has stated, this is a very important Bill. As a country, we have a very long coastline along the Indian Ocean. As a country, from the time we had oil discovered in Turkana County, we should be now utilizing the products from those wells. Clause 84 clearly defines how the national share from petroleum income is going to be shared in terms of what goes to the national Government, county government and to the local community. Local community is defined as a sub-county, which is very fair.
