Thank you, Hon. Temporary Deputy Speaker for giving me the opportunity to contribute to this Bill. I would like to start by congratulating the Member who has introduced these amendments. We have a huge population of youth in our country. I agree with the Leader of the Majority Party that setting the age of retirement at 60 does not necessarily mean that we will have all our youth being employed in the public service. However, moving that requirement from regulation to a statute is a good thing, such that unless The electronic version of the Official Hansard Report is for ...

there are extraordinary circumstances under which a certain Kenyan will be required to hold public office beyond the age of 60, we need to have a law clearly indicating that once somebody has obtained the age of 60 having served in the public service, the person should retire honourably.

Hon. Temporary Deputy Speaker, the other aspect which this amendment has touched on is the issue of people who are acting in offices. We have had situations where individuals have been allowed to act for close to a decade, to the extent that when those offices are supposed to be filled, it becomes a challenge. An example is when we were filling the position of the Chief Executive Officer (CEO) for the National Government Constituencies Development Fund (NG – CDF). Such a thing should not happen unless a Kenyan is required to hold brief for a CEO who is on ...

Thank you, Hon. Temporary Deputy Speaker, I would like to reply. I would like to thank all the Members who have contributed to this Report. It is very unfortunate that we lost 11 black rhinos – a species of animals which is endangered and which is a source of attraction for tourists who enable us as a country to earn foreign exchange. The Departmental Committee on Environment and Natural Resources had an opportunity to interrogate this matter. We invited the former board whose term lapsed. At the time of the death of those rhinos, there was no board in place. ...

Thank you, Hon. Temporary Deputy Speaker. This is a small amendment. It relates to the amendment of Section 16 of Public Service (Values and Principles Act). It is very much in order. The principal Act in terms of knowing what is supposed to be reported did not provide some crucial information. The amendment which is proposed and which I support, actually, brings in the aspect of reporting annually to His Excellency the President and also, to Parliament. There are specific things which were not in the principal Act which were being proposed to be included in terms of reporting. The ...

and constitutional commissions - then His Excellency the President and we, Members of Parliament, who undertake oversight role will be discussing these issues from a point of information. This is so that when we say certain ethnic groups or certain regions are underrepresented or overrepresented, we will be arguing from a point of fact. Therefore, the various recommendations which will be put across to correct those anomalies will be guided by facts. This being a short amendment, I wish to support it. It will help us to achieve the values and principles of public service as provided by Article 232 ...

Thank you very much, Hon. Temporary Deputy Speaker. I stand to support the adoption of this Report. I am also a member of this Committee. We have tried our best to visit as many dams as possible. Of course, we were constrained. Some of the dams which we wanted to visit did not fall under our Committee and that is why one of the recommendations we have made as a Committee is such that all water-related works be put under one ministry and there be a directorate to deal with dams. If we look at observations, there are some observations ...

Therefore, as a country our Government may not be in a position to do proper due diligence and we end up with a situation like the one we have found out with the case of Itare where a company- which in its own home country is bankrupt- has been given a multi-billion contract to do a pan in our country. Another thing we have also seen is that even when we look at our own engineers in the Ministry of Water and Sanitation, which we oversee, we realise that there are times particularly when the design is poorly done and ...
