As I conclude, I reiterate a point that was raised by other Senators before me; that this is a flagship legislative where the Senate intends to avoid or mitigate the massive legal cost that counties are incurring. The Senator for Homa Bay said that it is inconceivable that you are sitting on that Chair. I wanted to bring that to your attention. In what way is it inconceivable for the Chairman of the County Public Accounts and Investments Committee (CPAIC) and also one of Kenya’s highest ranking legislators to have no conception that he can sit on that Chair? I come from a county and communities that have felt particularly discriminated in matters of issuance of IDs. Kenyans of Arab-Somalia origin have had untold discrimination on the issuance of IDs. In addition, we need to appreciate the provisions of Article 12(1)( b ) which states:- “Every citizen is entitled to a Kenyan passport and any document of registration or identification issued by the State to citizens.” Issuance of IDs is not at the discretion of the Registrar of Persons. Dullo and I served in the Kenya National Commission on Human Rights (KNCHR), where she was in charge of penal reforms. This is an extremely important Motion for this Senate, so that we can start to interrogate the aspirations of our Constitution, particularly, when it comes to Chapter Four, which is the Bill of Rights.
