Hon. Temporary Deputy Speaker, our Constitution is very clear. It has gone a step ahead and in a further comprehensive manner, articulated the aspects of the environment in Articles 42, 69 and 70. It is always good to manage our environment so that we can live well. We can also pass it to future generations. The right to a clean and healthy environment is guaranteed in our Constitution. It stands as a mere guarantee. We have to do some other things to make sure that, that right is accessible and it benefits the common man.

It is also clear in the Constitution that for us to benefit from that right, the State has to do something progressive so that the benefit of that right as an entitlement is achieved. That comes along with resources and capacity issues. That is why that clause of progressive realisation of rights has been included in our Constitution. The biggest challenge to environment is pollution and litter. I believe that we must change our behaviour for us to attain a clean environment. That comes with serious civic education and creating awareness to the public. The State cannot attain a clean ...

Thank you. I strongly support this Motion with the new amendment. As a country, we are lagging behind in terms of compliance with the disability requirement. We are also failing Persons Living with Disability (PLWDs) in terms of ensuring an inclusive society. The environment is difficult. I was in a tour where we were in one of the counties of this country. We carried a person with disability with our own hands because the buildings were inaccessible. We need to change that and ensure we have an accessibility audit in this country to establish the level of compliance of this ...

Thank you, Hon. Temporary Deputy Speaker. The poverty level in this country is very high and it is mostly related to environmental degradation. We mismanage our environment and it has a direct bearing on our livelihood. This policy recognizes the existence of rights as espoused in our Constitution. We have a raft of rights in our Constitution, including environmental rights, food security, the right to safe and clean water and rights relating to recognition of the vulnerable communities. This is also related to people’s livelihoods and the environment. It is an important recognition and I believe that this policy has ...

26 Wednesday 2nd December, 2015(A) The rights in the Constitution are mere guarantees. For them to be fulfilled, we are required to take a step further and come up with strategies and policies that are actually measurable and can enable us take stock of challenges, so that we come up with the necessary indicators. It is only through such strategies that we can, at least, progressively implement the rights enshrined in our Constitution. This strategy further complements Vision 2030 on sustainable development; it is anchored on people development through rights-based approach. It is only through such kind of initiatives and ...

Thank you, Hon. Temporary Deputy Speaker. Traditions and cultures are derived from community livelihoods. They say necessity is the mother of invention. How communities toil to eke a living and how they struggle to at least cope with their immediate environment defines their behaviour, way of life and beliefs. That has over the years been communicated informally to the next generations through imitations and oral communication. As much as it is a constitutional requirement that this Bill has to be enacted, it is a milestone today in the history of this country that we are trying to develop laws of ...

is the fact that we must appreciate our cultures and traditions without delving much into ownership. It is cross-cutting. It is just like discussing ancient migratory routes. Every community in Kenya claims to have come from somewhere. If you will be talking of ownership of cultures, then we will be delving into a bottomless pit which may not deliver results. It is just good to appreciate our cultures as divergent as they are. The issue of ownership is not something that can be easily resolved. One other thing is on the objectives of this Bill. It is good, but it ...
