  • 2 Dec 2015 in National Assembly: 15 Wednesday 2nd December, 2015(A) human rights in Kenya was conducted. In 2006, a national stakeholders’ conference was held and this process was officially launched. In 2012 the Cabinet considered the policy paper. This Sessional Paper was tabled in this House this year. My concern is that from the time this process started in 2005 to 2015 it is a period of 10 years. If we take 10 years to formulate a policy or a sessional paper, then how long will it take this Government to implement the same? The implication is that if the Jubilee Government takes 10 years ... view
  • 2 Dec 2015 in National Assembly: This Sessional Paper touches on quite a number of State departments. It should be very clear which State department is responsible for which Action Plans. We should also be very clear as Parliament that for proper implementation of these Action Plans, we must provide the necessary budgetary allocation required by the relevant State departments for them to fully implement this Sessional Paper. There is a statement on page (vi) made by the Attorney-General (AG) which I agree with. He says:- “While the protection of human rights is primarily the responsibility of Government, I call upon the private sector, civil society ... view
  • 1 Dec 2015 in National Assembly: Thank you, Hon. Temporary Deputy Chairman, I wish to inform my brother, Hon. Wamalwa that it is not a must for the Committee to table a report when dealing with such amendments. If, indeed, we did not agree on this compromised amendment, we would have rejected some of these provisions as a Committee. We consulted and agreed with the amendment by Hon. Chepkong'a. We support the amendment so long as the CAK, together with the Competition Authority, after following the due process, declare--- view
  • 19 Nov 2015 in National Assembly: Thank you, Hon. Temporary Deputy Speaker. I want to thank Hon. Nyokabi for this Bill. As a Committee, we held some meetings with various stakeholders in this sector including the Ministry of Information, Communication and Technology, the Private Sector Alliance International Commission of Jurists and the Media Council of Kenya. We also received some memoranda from the Kenya Private Alliance, the Media Council of Kenya and Safaricom Limited. We captured their views which are contained in the Report that we tabled yesterday. As a Committee, we analysed the various submissions from the public. We observed that some of the amendments ... view

  • 22 Oct 2015 in National Assembly: Thank you, Hon. Temporary Deputy Chairlady. I stand to support the proposal by the Chair of the Committee. Indeed, at the moment, in the Departmental Committee of Energy, Communication and Information, we are going through the Petroleum Bill. The issue of compulsory acquisition of land has also come up. Indeed, before this House we were also discussing the Community Land Bill. Therefore, it is necessary for us to have one universal law whereby every other person or the Cabinet Secretary (CS) can be directed. We do not have to have different sets of Acts and laws in different Bills. view

  • 22 Oct 2015 in National Assembly: Thank you, Hon. Temporary Deputy Speaker. I wish to thank the Deputy Leader of the Majority Party for moving this Bill. I stand to second it. As she has said, this Act will give effect to the relevant Articles of the Constitution in so far as they apply to upstream petroleum operations. view
  • 22 Oct 2015 in National Assembly: As a Committee, we have held discussions with the CS in charge of Petroleum and Energy, the civil society and other stakeholders. As we move towards the Committee stage of this Bill, we will be coming up with more amendments as a Committee. I want to believe that by then, some of the issues which have been raised by stakeholders will have been clarified. In seconding this Bill, I want to address myself to three key issues. One is the issue of permits and licences in relation to red tape. This Bill has a number of permits and licences that ... view
  • 22 Oct 2015 in National Assembly: We are also proposing as a Committee that once you apply for a permit or licence, the time taken by the CS, or the relevant authority, to approve the application must be stipulated in this Act. There is no way you can apply for a permit and it takes the CS more than a month or two. Depending on the mood of the CS, you may not even get that licence. Therefore, we propose some time frame upon which a permit must be issued. This Bill has quite a number of proposals when it comes to fines and penalties. If ... view
