Mr. Temporary Deputy Speaker, Sir, in the first place, I want to approach this matter from a logical point of view. You cannot pay monies earlier than due and argue that at that point in time, you are not spending additional funds. You are now presiding over a Bill that touches on the Constitution of Kenya which requires that any money Motion or Bill must receive Presidential consent before it comes to the House. Is it in order that you should allow that to happen?

On a point of order, Mr. Temporary Deputy Speaker, Sir. I am a pensioner myself. Although pension is not a right, in the sense of human rights, pensions are earned. Everyone should be paid oneâs pension but we have an obligation, as a House, to defend the Constitution of this country. If you pay today money that you are expected to pay in the year 2011, to say that you are not drawing monies that you should not have drawn at that particular point in time is avoiding to be reasonable. Mr. Temporary Deputy Speaker, Sir, I rise to support this Bill because it has been regular in this House. Every year, we have to have a Finance Bill. That is how it should be because that process gives this House the opportunity to express views and even to advise the Deputy Prime Minister and Minister for Finance on how the House sees the financial and economic situation of the country. On a point of order, Mr. Speaker, Sir. I wish to seek your guidance. As clarification was being sought from the Minister, hon. Wamalwa stood up and said, and I will paraphrase his statement: âKenya is supposed to be governed under the rule of law.â For the sake of our records, is Kenya supposed to be governed under the rule of law or it is a fact that Kenya is governed under the rule of law?

On a point of order, Mr. Deputy Speaker, Sir. I wish to seek your guidance because I want to understand the way this debate is going, so that I can internalize the issue. A section of the Constitution has just been read with regard to the collective responsibility of Cabinet Ministers. Is it constitutional to allow any Member who is in that category to infringe the Constitution, which he has vowed to defend?
