I must say that I agree with hon. Gumbo on the manner of drafting of these Bills and the fact that the Committees really need to bring their reports. But even as we say that Committees need to bring their reports, the House Business Committee, as well, must also give Committees sufficient time.   • 20 Nov 2014 in National Assembly: not necessarily be with the Committees per se, but also the House Business Committee should consult with the Chairmen of the various Committees to know at what stage they are deliberating the Bills, so that Reports can be brought to the House. Nevertheless, this is one of the Fourth Schedule Bills that the Legislature is required to pass. I have looked through the Bill and I notice it is a good Bill generally, but it requires some panel beating. I believe we would have probably debated the Water Bill first because it talks about resources. An environmental Bill will also touch on the issues of land, basins and others. Therefore, this is a Bill that should have come after we have debated other legislations. We can follow and even quote the other Acts even as we debate this Bill. I know Senator Kajwang’ as an astute lawyer and a member of the Law Society of Kenya (LSK). I have known him since my days in practice; actually since my days in high school. As a matter of fact, every hon. Member has situations in their constituencies regarding water. The Bill as drafted is good but there are certain areas that we need to take a harder look at because of what appears to be duplication of functions within the authorities that have been under this Bill. I want to close in subsection 2(b) on social justice because water is life and when you are talking about life then you have to talk about constitutional provisions that give the basis of this Bill. What we are creating are establishments within this Act that will require the governance of these establishments to have good governance.   • 30 Oct 2014 in National Assembly: If you look at Article 43, which also anchors this Bill, it talks of economic and social rights. It is a constitutional provision that everyone must have access to water. So, in Article 43(1)(b), we talk about access to housing and reasonable state of sanitation. We are talking about sanitation here because, this Bill, as much as it talks about water, it also talks about sanitation. Article 43(c) talks about freedom from hunger. If you look at the membership of the National Water Harvesting and Storage Authority and you look at the membership of the Water Resources Regulatory Authority, they are exactly the same because they have the chairpersons, of course, appointed by the President, then they have got Principal Secretary for Water, Principal Secretary for land, Principal Secretary for Finance and four members appointed by the Cabinet Secretary.
