Thirdly, where the counsel who is cross-examining - and that will apply even when the laws are reversed - if the question requires a ‘yes’ or ‘no’ answer, it should just be answered by a yes or no and that is it. The idea of hunting each other is not helpful.

Madam Deputy Speaker, the request for the hearing of a witness offsite, which I understand to mean outside here, is not possible because the sitting of a House of Parliament is gazetted, and the legal process of moving that site will take days, which we do not have. In the court of law, where the Judge is where the court sits, so long as the judge would like to move for purposes of doing something. It is not practical for us to sit outside where we are seated. That effort will take several days, and we do not have that ...

Number two, the request to hear a witness in-camera is allowed by the law and in our Standing Orders. By this, it means that only Senators and the parties will access the proceedings. I hope that, that is what is meant by in-camera. So, in-camera is allowed. Offsite would be allowed, but it would not be practical because of the strict constitutional timelines that we have. It would involve gazetting a sitting outside this Chamber, which is the official recognized sitting of the Senate under the Constitution.

Thank you, Madam Temporary Speaker. What does this consensus mean? This consensus means that unity has defeated division. This consensus means that equity has triumphed over marginalization. This consensus means that today devolution has won over centralism. I will take a very short time. I will only say that Tharaka Nithi was threatened with a revenue loss of nearly Kshs499 million. Today it will gain Kshs289 million, meaning the net gain is Kshs788 million; from Kshs-499 million to Kshs+289 million. The people of Tharaka Nithi will be forever grateful to this House. The people of Tharaka Nithi will be grateful ...

supposed to gain under a flawed formula, but they decided to forego the immediate gratification of their counties for the sake of the unity of our great nation. I am advised and instructed by the people of Tharaka Nithi to thank in particular, Sen. Kipchumba Murkomen, Sen. Johnson Sakaja, Sen.(Dr.) Langat, Sen. Malalah, Sen. (Dr.) Kabaka, Sen. Cheruiyot and Sen. Linturi who is also my neighbor. Due to the sacrifices they made today, it is not Tharaka Nithi that has won. Even the people behind the flawed formula have gained much more money than everybody else. Madam Temporary Speaker, I ...

Mr. Speaker, Sir, thank you for that ruling. I want to plead with you to guide us further by reconsidering your own ruling because this is the most important issue in this country at the moment. If we are discussing whether or not to adjourn, assuming Sen. Murkomen’s Motion carries the day, there are consequences. Likewise, even if the Motion by Sen. Murkomen does not carry the day, there are also serious implications.

Thank you, Mr. Speaker, Sir. We want to make it clear that there will be no crisis in the counties because they will be able to access 50 per cent of what is due to them based on last year’s figures. The media should not promote a narrative that counties will be in a crisis of funds. We began on a wrong footing where counties were pitted against each other like the legendary story of Gog and Magog, but I am happy that this battle has now come to an end. We are now 47 counties under the territory of ...
