They are still private entities. You will have noticed that the democracy within parties is only at the lower levels; the constituency, district and county levels but at the national level, it is until that leader stops contesting for the presidency. If you look at Article 81(e), you will find that it talks about free and fair elections. For the political parties to come up with nine names for ODM and 12 names for PNU, they must have conducted some form of in-house election.
