  • 12 Nov 2014 in National Assembly: Hon. Temporary Deputy Speaker, under Standing Order No.54, I beg to move the following amendment:- THAT, the Motion be amended by inserting the words “and creation of a CBD Parking, a bus terminus, modernization of Wakulima Market, expansion of the railway terminus and building of an overpass” immediately after the word “roads” at the end of the last sentence. Hon. Temporary Deputy Speaker, having heard hon. Gakuya move his Motion, it is clear that the 50 acre parcel of land that is available for purchase from the Railways Pension Scheme is not just intended to expand Landhis Road and Jogoo ... view
  • 12 Nov 2014 in National Assembly: With those remarks, I beg to move and request the Member for Njoro to second the amendment. view
  • 12 Nov 2014 in National Assembly: Thank you, hon. Temporary Deputy Speaker. It is important that hon. Members in this House understand the importance of the amendment. When the original Motion was being moved, it was very clear that hon. Gakuya had in mind the 50 acres being more than expansion of the two roads. He is the one who introduced the expansion of the market and the Machakos Bus Terminus. If any person has gone to that particular area, 50 acres is the entire Muthurwa Estate; actually a whole estate. So, if we urge that, that land be used for the road and mark you, ... view
  • 30 Oct 2014 in National Assembly: Hon. Speaker, I want to add my comments on the issue of separation of powers. I am a strong supporter of that doctrine and concept. Looking at the Judiciary during the KANU days, there was every reason for everyone to fight for that separation. The Judiciary is becoming the dictator in this country. It is emasculating the authority and the constitutional mandate of the Executive. It is actually tying the hands of the two Houses of the Legislature. In my opinion, when we decided to give jobs to people based on qualifications of activism, that is where we went wrong. ... view
  • 30 Oct 2014 in National Assembly: Those are the people who are determining the fate of this country. They think they can injunct the President from going to State House or Harambee House. It is important that the Judiciary realized that without Parliament and the Executive, we cannot have a country. In the very near future, the other two arms of Government and this country might say enough is enough and that is going to be very dangerous. Let them respect the principle of separation of powers without becoming the dictator of the three arms of the Government. view
  • 30 Oct 2014 in National Assembly: Hon. Deputy Speaker, my colleagues who have spoken before me have given a good explanation of what is happening. I want to suggest that we should report progress, but we need to be very careful – although I have not had a chance to look at the timelines - to ensure that the proposed amendments by the President do not carry the day when we are on recess. We must be very careful even as we debate the Motion when it comes. As a lawyer, I am telling you that the moment the Ethics and Anti- Corruption Commission makes a ... view

  • 28 Oct 2014 in National Assembly: Hon. Chairlady, since I came after the Speaker had made the ruling I hope I will not be going against its spirit. There is no doubt at all on Clause 29(a) because its intention is to create a board. The creation of a board amounts to an anticipated expenditure. The Constitution is very clear that if you want to spend money – there is no way of going around it – you must present an issue to the Budget and Appropriations Committee which must bring here a report on that particular issue after consulting the Cabinet Secretary for Treasury. There ... view
