asked the Minister of State, for Aministration and National Security:- (a) whether he is aware that a sum of Kshs194,844.90 meant for the construction of the District Officer's office in Samburu Division has not been October 9, 2007 PARLIAMENTARY DEBATES 4387 accounted for since 2003; (b) who the contractor awarded the tender was; and, (c) what measures he is taking to restore the confidence of the community and ensure the amount in question is accounted for.

Mr. Speaker, Sir, the exercise of constructing this DO's office was done in 2001. When the community was not satisfied with what was happening because of interference by the then DO, a probe committee was formed and a report was tabled on 2nd September, 2003. One of the recommendations of the committee was that there was a shortage of about Kshs194,000, and part of this money had actually been taken by the DO. Mr. Speaker, Sir, could the Assistant Minister explain to the House the purpose of this inordinate delay? This matter was raised by the community in 2003. I have a report which I wish to table before the House. The Assistant Minister should tell us when this money will be recovered and sent back to the DO's office, Samburu, for the construction of this particular office.

asked the Minister for Labour and Human Resource Development:- (a) whether he is aware that over 40 people hired on casual basis by a sub- contractor (Kang'ethe Contractors) at Nyari Sisal Estate, Taru, between 2005 and 2006, have not been paid their dues; and, (b) what steps he is taking to ensure that the workers are paid their dues.

Mr. Deputy Speaker, Sir, cases of this kind are very rampant. I do not see the reason why somebody should be confined in prison if the complainant has not written a statement first. The employees have been released, but no action was taken against the employer because he did not write a statement. This is not right. These people, who were working there, are citizens of this country. We need an explanation from the Minister as to why people are confined in prison, without the complainants, first, recording statements with the police. We also need to know why it has ...
