Hon. Speaker, I am not a Member of that Committee but I am asking: “Are we saying that if you are an accounting officer and you are given wrong instructions, you go and act on those wrong instructions, when you know the Constitution is very clear that that should not be done?” Is that what we are saying? We have a very clear Act of Parliament which we call the PFMA. This Act stipulates very clearly how public funds should be managed. The person who implements those wrong instructions is the one to takes responsibility. Why is the Chief Registrar ...

I second this amendment by saying that the recommendation should be deleted for the reasons I have explained. It is very clear that the Chief Registrar is the accounting officer of the Judiciary.

Thank you, Hon. Temporary Deputy Speaker. I must start by appreciating the work of the PAC of this House. If you read this Report and have heard the way it has been presented by the Chairman of the Committee, this House has a responsibility to thank that Committee for the work well done. Hon. Gumbo’s presentation was excellent. He gave us a lot of details and, therefore, I will not focus on the details. This Report is dated May, 2014. To some extent that worries me because we are in 2016. This was a Special Audit Report initiated by this ...

beating a dead donkey, it is very disappointing. Kenyans must be very disappointed when they hear that this House is discussing reports like this. As we move forward, this Report has captured the issue of irregular payment of allowances. You are paid an allowance, and yet you are not entitled to that allowance. That is why I like the recommendation that states that in such a case, people must take individual responsibility. If it is written that it is Hon. Makali Mulu who was paid that irregular allowance, the Government has no choice but to make sure that the money ...

Thank you, Hon. Temporary Deputy Speaker. I support this Procedural Motion but, even as I support it, I want to make some observations. A Private Member’s Bill is very serious. Generally, Bills are serious matters in this House. As we pass this Procedural Motion, it is important that we realise that it takes a lot of research for a Member to come up with a Bill. At the same time, as we agree on these timelines, it is important to also think about the quality of debate. I have realised at times that the 10 minutes might not be enough ...

I want to start by thanking Hon. Mule, the MP for Matungulu, for coming up with this important Bill. This being a Private Member’s Bill, we must all appreciate the fact that the efforts which have gone into it are commendable. As a Member of the Wiper Party of Kenya, I want to associate myself with Hon. Mule. He is doing well by promoting our party as well as the coalition that we belong to. Thank you Hon. Mule for coming up with this Bill. Having read this Bill, I want to say that it is quite timely. We are ...

Another issue that we also need to consider is what I would call “non-status organisations”. This would be more of a parastatal. If it gets public funding, the question is how we tie the parastatal reforms in this country. We are talking about merging parastatals which perform similar functions so that we reduce the number, implying that we are reducing administrative expenses emanating from parastatals and yet this Bill will effectively be proposing an increase in the number of the existing parastatals.

These are the critical questions we need to ask as a House and see how we can balance them. But at the end of the day, ensure that Kenyans benefit out of those important services. As it has been said, many a times you hear of cancer patients being referred to Kenyatta National Hospital and while there, they get into a queue which last for ten months. If you go and join a queue, it takes ten months for you to get access to that machine. That becomes a very tricky situation because we want our people to have that ...

Thank you, Hon. Speaker for giving me this chance. I have taken a bit of time to read this Report. I must say that in terms of qualification, competence and relevant experience, it is coming out clearly that the nominees are qualified. The only thing that is not coming out clearly is how their academic qualifications and competencies are aligned to the positions they have been nominated for. That is an issue which we would be raising if we were to be technical. I also bear in mind that, at this level, it is more of a strategic policy direction. ...
