Hon. Temporary Deputy Speaker, I apologise for that omission. I have just been given the Report by the Majority Whip and, indeed, in the last page there are signatures of the Members. I am sorry, for that omission.

The last point is that we know that the appointment of these Members is based on the NG-CDF Act. However, as we know when making public appointments, we also need to consider the Public Appointments (Parliamentary Approval) Act. I have gone through the Report and it is only making reference to Section 8 of the Public Appointments (Parliamentary Approval) Act. I want to bring to your attention Section 7 of Public Appointments (Parliamentary Approval) Act, which requires that the procedure used to arrive at the nominees be provided.

Though the NG-CDF Act gives the CS, National Treasury and Planning, the powers to make the appointments, Section 7 of the Public Appointments (Parliamentary Approval) Act requires that while making public appointments, the issues for consideration by the relevant House of Parliament in relation to nomination shall be the procedure used to arrive at the nominee. However, this seems not to have been captured in this Report.

At the outset, I support the Motion but I want to raise a very important procedural issue about it. The Public Appointments (Parliamentary Approval) Act, 2011, in Section 5 talks about notification of nomination. It requires that the appointing authority when communicating the nomination to the House must provide full information about the procedure that was used to nominate the individuals.

Hon. Temporary Deputy Speaker, I am raising this issue because, having read the Report, I noticed that that particular information is missing. According to the law, it is a requirement for communication from the appointing authority. He must explain the process that was used in nominating these individuals. I am saying this because one of the people who applied for these positions happens to come from my county; that is former Speaker of the National Assembly, Hon. Kenneth Marende. All of us know that Hon. Kenneth Marende is a distinguished lawyer qualified to serve in the High Court. He is ...
