  • 26 Jul 2011 in National Assembly: On a point of order, Mr. Deputy Speaker, Sir. The Report that is being delivered by the Minister arising from the Motion passed by this House in 2008 is made pursuant to Standing Order No.183. This says that the Minister responsible must table the action taken within 60 days of that Report. A Minister who fails to submit a Report under this Standing Order shall be deemed to be disorderly within the meaning of Standing Order No.97. Therefore, having been disorderly the first thing the Minister should do is to apologize and ask for retention of time. view
  • 21 Jul 2011 in National Assembly: On a point of Order, Mr. Speaker, Sir. I rise on a point of order to bring to the attention of the House a matter that, in my humble view, touches on the privileges in the National Assembly (Powers and Privileges) Act, and the Constitution on the freedoms and rights of Parliament. I am referring to the Judgement of Nairobi High Court Civil Case No.1250 of 2004 – George Odinga Oraro versus Erick Gor Sungu – delivered by Justice K.H. Rawal on 14th July, 2011. From the outset, I wish to say that the issues I intend to raise on ... view
  • 21 Jul 2011 in National Assembly: Mr. Speaker, Sir, the Judgement I am referring to, and the issues I wish to seek the Chair’s direction on, is, first of all, how that Judgement erodes the supremacy of Parliament by negating the principles of Parliamentary privilege, under the National Assembly (Powers and Privileges) Act, Chapter 6, Laws of Kenya, and how it impacts on the provisions of Section 117 of the Constitution. Mr. Speaker, Sir, I wish to quote, for the benefit of Members, Article 117 of the Constitution; Powers, privileges and immunities:- view
  • 21 Jul 2011 in National Assembly: (1) There shall be freedom of speech and debate in Parliament. (2) Parliament may, for the purpose of the orderly and effective discharge of the business of Parliament, provide for powers, privileges and immunities of Parliament, its Committees, the Leader of Majority Party, the Leader of the Minority Party, the chairpersons of committees and Members. Mr. Speaker, Sir, that judgment arises from actions of Eric Gor Sungu as the Chairman of a Parliamentary Select Committee inquiring into the demise of the late hon. Dr. Robert Ouko. He is alleged to have uttered certain words within the precincts of Parliament that ... view
  • 20 Jul 2011 in National Assembly: Mr. Speaker, Sir, the question posed by Mr. Mutava Musyimi is quite fundamental and raises very serious issues. The House must commend the Right Honourable Prime Minister for giving a full answer to this question. However, the issue that come to play, now that he has explained the background is that the service contract should have been given to the Commissioners to sign before they were sworn in. As it is, the service contract was formulated after they were sworn in hence the trouble we are in now. Under the circumstances, what action has the Government taken to ensure that ... view
  • 20 Jul 2011 in National Assembly: On a point of order, Mr. Speaker, Sir. In view of the answer by the Right Honourable Prime Minister, is it in order for the Chairman of this Commission to behave as if he is the Third Principal in this country? view
  • 20 Jul 2011 in National Assembly: It is in relation to the same matter, Mr. Speaker, Sir. view
  • 20 Jul 2011 in National Assembly: Mr. Speaker, Sir, I rise on a point of order and wish to state categorically that I wish to adopt the point of order by Dr. Eseli and Dr. Khalwale. In addition to that and with respect to my learned friend, the Minister for Justice, National Cohesion and Constitutional Affairs, I believe that he has done the wrong thing because he has misunderstood Part 5, Clause 59 of the Constitution. What he needs to do is to create one commission comprising of all the three commissions which are separated in the Bills. For the proper understanding of the writing and ... view
