Mr. Speaker, Sir, you will notice that in this case the Assistant Minister is relying on the inquest. This is clearly a case of extrajudicial killings and the police should not be expected to compile the inquest file, prosecute it themselves and then come out with the truth. I kindly ask the Chair that this matter be referred to the Departmental Committee on Administration and National Security so that more details can come out.

Mr. Deputy Speaker, Sir, I am asking this question out of experience. The ancestral land in Lamu that hon. S. Abdalla is talking about is classified as trust land. In effect, the Lamu residents who are living on that trust land are treated as squatters of the Government. In Kisumu, land was acquired for expansion of the town and the owners of the ancestral land were evicted and paid minimal compensation. That land has now been allocated to private developers. What steps is the Ministry taking to ensure that ancestral owners in Lamu will not lose their interest?

On a point of order, Mr. Deputy Speaker, Sir. Is it in order for the Assistant Minister to display ignorance and say that trust land is Government land when, actually, the Government is holding the land in trust for the residents?

Thank you very much, Mr. Temporary Deputy Speaker, Sir. Although there are weaknesses and strengths in this Bill, we should not throw away the baby with the birth water. I want us to appreciate the effort of the Ministry for Justice, National Cohesion and Constitutional Affairs in bringing this Bill. He gives us the foundation on which we can strengthen the Bill and in the process, strengthen democracy and political parties in our country. The Minister has said that it is an oversight and I hope that when we go to the Committee Stage, we are going to have an amendment that is going to correct that anomaly. The second issue that I want to talk about is the dispute resolution mechanism that is set out in Clauses 36 to 41 in the Bill. (a) Under what circumstances did Felix Riaga Odera drown in Lake Kawkawa in British Columbia, Canada, on 29th May, 2011? (b) Has the Kenya High Commission in Canada taken any steps to ensure that a full investigation is carried out and, if so, what were the findings? (c) What role did the Kenya High Commission play in assisting the family to transport the remains of Felix Riaga Omolo back to Kenya for interment?

Mr. Speaker, Sir, the hon. Assistant Minister must be fully aware of the fact that Felix Riaga Odera was the best KCSE student in 2004 from Starehe Boys Centre. I am saddened by this part of the answer. My question was to find out if there was any wrongdoing on part of anybody. The answer reads as follows: Two of the friends of Felix took his wallet, swung him three times and threw him into the lake. He raised his hands as he was going into the water giving an okay sign, but he did not resurface”.

Mr. Speaker, Sir, that alone indicates that Felix was actually thrown into the water against his will. Under these circumstances, what did the police in Vancouver doing to ensure that the two culprits who threw him into the water are arrested and charged with causing death by reckless conduct?

On a point of order, Mr. Speaker, Sir. This is a matter that should not be taken lightly by the hon. Assistant Minister. If the evidence that he has in his hands indicate that he was swung three times into the lake, is it in order for him to state to the House that this was not premeditated?
