Mr. Speaker, Sir, the answer by the hon. Assistant Minister raises very serious concerns about impunity by the Police Force and the way the Force treats its junior officers. Many times, junior officers are interdicted, charged in court, acquitted and then dismissed. In this case, what is disclosed is not even double jeopardy, but triple jeopardy in the sense that first, this officer is charged, two, he goes through Orderly Room proceedings and three, he is found innocent and then dismissed. On a point of order, Mr. Speaker, Sir. Is the Assistant Minister in order to talk about this officer having lost a firearm when the proceedings he has show that this officer was acquitted of that offense?

asked the Attorney-General: (a) whether he is aware of the judgment of Kshs1,051,500 with costs and interest awarded in Mombasa HCCC No. 723/1990 to Gabriel K. Namisi and 14 others; (b) why the Government has failed to discharge the decree of the court, despite all the attempts by the Decree Holders over the period of over 12 years; and, (c) what steps he is taking to ensure that the Government complies with the law and discharges the decree by paying the plaintiffs.

Mr. Speaker, Sir, it is incredible that 12 years after judgment was delivered by the court, the A-Gâs Office and the Ministry concerned have not paid. Could the A-G confirm that the impunity that is being demonstrated by failure of the Government to pay court decrees is as a result of the immunity that the Government has under Cap 40, Section 21, Government Proceedings Act? If it is not true, then there needs to be an amendment to that section so that the Government is open to scrutiny like every other party. This problem is all over the country.

Mr. Speaker, Sir, the A-G is the constitutional advisor to the Government. For him to say that he is now impotent, and asking that Questions be directed to the Ministries concerned, is he not running away from his responsibility as the legal advisor?

On a point of order, Mr. Deputy Speaker, Sir. I wish to concur with what hon. Shakeel has said, that, indeed, the answer given by the hon. Minister is not true. I can vouch for it. Would it not be in order, under the circumstances, that this Question be deferred and in the meantime, the Minister goes to the Provincial Commissionerâs (PCâs) office in Kisumu to have a look at it personally with the engineers? The answer he is giving is wrong.

Mr. Deputy Speaker, Sir, I said that I concur with the sentiments of hon. Shakeel, that the building is not connected to sewer and power. So, the answer that the Minister is giving is clearly wrong.

On a point of order, Mr. Deputy Speaker, Sir. The proposal by the hon. Minister is quite reasonable. I think it should be acceptable to both hon. Shakeel and I. However, could he add a rider that when he is visiting that area, he will invite the hon. Members from that area - hon. Shakeel and I - so that we can accompany him because the same engineers who are giving the wrong information are the ones who will lead him there?
