  • 12 Nov 2008 in National Assembly: Mr. Deputy Speaker, Sir, I rise on a point of order to raise a matter of very great concern, not just to this House but, I believe, to the entire Republic of Kenya - a matter which touches on the supremacy of Parliament. I wish to seek the Speaker's direction and ruling. I wish to lay on the table, copies of pleadings and ruling in Judicial Review--- view
  • 12 Nov 2008 in National Assembly: Thank you, Mr. Deputy Speaker, Sir. As I was saying, I am rising to raise a matter of very great concern, not just to this House, but to the entire Republic of Kenya; a matter that touches on the supremacy of Parliament. I wish to seek your direction and advice. In so doing, I wish to lay before the House, copies of pleadings and rulings in Nairobi High Court, Judicial Review Petition No.689 of 2008 in the matter of Samuel Mutua Kivuitu, the ECK Chairman and 21 others, versus the Hon. Attorney-General. The ruling that I have just referred to ... view
  • 12 Nov 2008 in National Assembly: It is a direct erosion of the powers and supremacy of this Parliament. The Judiciary has the responsibility to adjudicate on the legality of a legislation that Parliament may enact. But the Judiciary cannot stop debate in this House. The Government Proceedings Act, Chapter 40, specifically outlaws orders of injunction against the Government. I also wish to refer to the National Assembly Powers and Privileges Act, Chapter 6. Section 12 of that Act specifically says:- "No proceedings or decisions of the National Assembly shall be questioned in any court." The National Assembly Powers and Privileges Act is an Act of ... view
  • 30 Oct 2008 in National Assembly: asked the Minister for Regional Development Authorities:- (a) whether he could indicate how much funds the Lake Basin Development Authority has received from the Government of Kenya and from external sources, year by year, for the last 20 years; (b) what major sustainable projects the Lake Basin Development Authority has undertaken in the last 20 years; (c) whether he could confirm the routine and special audit carried on the Authority in the last 20 years, and explain what the same have revealed; and, (d) what steps the Ministry has taken to revive the stalled construction of the Lake Basin Development ... view
  • 30 Oct 2008 in National Assembly: Mr. Deputy Speaker, Sir, the Lake Basin Development Authority (LBDA) was created under an Act of Parliament to stir development in the whole of Western Province, Nyanza Province, and to a large extent, in parts of southern Rift. However, it is very clear from this answer that the operations of this Authority have been hampered by lack of sufficient funding. Could the Minister assure the House that steps have been taken to ensure that the Authority shall be properly funded to carry out its mandate? view
  • 30 Oct 2008 in National Assembly: No further questions. view
  • 30 Oct 2008 in National Assembly: On a point of order, Mr. Deputy Speaker. It is becoming increasingly clear that Ministers do not take their work seriously; if apologies are going to be tendered in this House the way they are being tendered then the Chair will be encouraging laxity on the part of Ministers. view

  • 30 Oct 2008 in National Assembly: Yes, Mr. Deputy Speaker, Sir. view
  • 30 Oct 2008 in National Assembly: Mr. Deputy Speaker, Sir, the answer from the Minister is unsatisfactory and I am asking for your direction. Is this House bound by decisions of the Cabinet? What if the Cabinet refuses to adopt the report? view
