Speaker, arising from your directions last Thursday, the Departmental Committee on Justice and Legal Affairs met with the Chief Executive Officer (CEO) of the Independent Electoral and Boundaries Commission (IEBC) yesterday, with me as the Temporary Chair. I have had the privilege and honour of serving in this Committee as a ranking Member and I wish to draw the attention of this House to the fact that the 21st Report contains reports on 42 State corporations as set out between page 3 and page 4 of the Report. In this report, we have emphasised that whether the appointing authority is the President or the Cabinet Secretary in charge of the docket, their responsibility under the law is to ensure that vacancies in State corporations are filled expeditiously. We have also recommended that in appointing board members, the appointing authorities should ensure that the appointments are staggered so that members of the board do not leave at the same time. Thank you, Hon. Speaker. The issue here is very fundamental. Hon. Midiwo has set the record straight. It is not just a question of the amendments but of whether we are complying with our Standing Orders or not. From experience, we know that towards the end of any term of Parliament sometimes the Executive files amendments which are very notorious. I do not want to impute any motives on my very good and trusted friend, Hon. Musyimi. I believe what he is doing is in good faith. Unfortunately, he is doing it the wrong way.
