At the outset, the three arms of Government are independent of each other, interdependent and also complement one another. This Act will enhance the operational and financial independence of the Judiciary as per the first objective. It will also ensure accountability of funds allocated to the Judiciary and ensure that it has adequate resources to conduct its business.   • 21 Apr 2016 in National Assembly: In terms of accountability and monitoring implementation, the Act is very clear that the accounting officer of this Fund is the Chief Registrar. The Fund will be subject to the existing financial regulations and will be audited by the Auditor-General three months after the end of the financial year. That kind of system will address the worries that we have. The bigger worry for Judiciary is the corruption of the system itself.   • 21 Apr 2016 in National Assembly: It is my hope that for areas like mine where justice is delayed and they say justice delayed is justice denied, this Act will bring into effect additional resources to support construction of additional facilities in the form of lower courts and higher courts so that people in this country can get justice wherever they are. view

For me, my concern with this Bill is the issue of the northern part of Kenya, which has large land mass and where most of it is currently trust land.   • 2 Mar 2016 in National Assembly: For those areas which have not had any legal framework of ownership of land, what the Bill lacks is that it talks about community land registration. But it does not talk about community registration for purposes of ownership of land. That, in effect, means that, for those areas - and knowing what Kenyans can do - this becomes a challenge because they already face a lot of challenges and conflict because of border issues. My reasons are as follows:- The Transition Authority was to facilitate the transfer of functions. That process has not been completed because there are many loose ends. The process of devolution faced a lot of challenges from the outset because it was a new system. Even though those challenges still remain, this House has the powers to extend the term of TA.
