Number 162, Hon. Chairman. As I second, I hope the monies contributed by Parliament will go towards testing for COVID-19. The reason why we declared 10 positive cases today – 1 in Nairobi and 9 in Mombasa - is an indication of insufficient testing.

We hope these monies will help in securing highways, specifically the highway touching Eldama Ravine. Between Makutano and Timboroa, there are many trucks that make stops on a daily basis. We need serious surveillance along that route. We hope the MTRH, which has received some allocation, will secure that particular corridor. With those remarks, I second.

Thank you, Hon. Speaker. As the Budget and Appropriations Committee, we went through the sentiments given by Members. I want to inform Members as I support this Motion, that this is the Division of Revenue Bill which shares monies between the two levels of Government. At this stage of this Bill we do not know how much money is for the Nairobi County Government. This Bill will determine how much money will go to Nairobi County Government from which the county assembly will determine the resources to go to the functions transferred to the Nairobi Metropolitan Services. It is not our mandate, and if you read Article 187(2)(b) of the Constitution it states: (b) “Constitutional responsibility for the performance of the function or exercise of the power shall remain with the government to which it is assigned by the Fourth Schedule”. As I second, this House should know that the Budget and Appropriations Committee was not happy about the application of Article 223 of the Constitution by the National Treasury. It came to our notice during consideration of the Supplementary Estimates that the application of Article 223 is not always in accordance with the law.
