Address that was presented to this House yesterday by His Excellency the President of the Republic of Kenya. I also take this opportunity to congratulate him for his sober-minded Speech. On behalf of the people of Funyula Constituency, Busia County, I wish that what was contained in the Speech be truly implemented for the betterment of this country. There are a few highlights from the Speech that are worth mentioning or commenting on. The first one was the public apology in respect of the outbursts, comments, activities, actions and omissions that occurred during the campaigns. After the campaigns and, probably, ...

We have taken 50 years quarrelling and unable to fulfil the expectations of our founding fathers. It would be a tragedy to take another 50 years having not achieved the basics of this country. It is time we refocus. What can we do to lower the temperatures and the heated moments that characterises the election campaigns in this country? It is time that the 14 men advisory committee that was formed last week, sits down and literally examines this issue in details, and ensures that the next campaigns are not characterised by heated debates and do not leave over half ...

This is a country endowed with a massive amount of resources but corruption has literally retarded its growth and development. It is time the President of the Republic of Kenya, being the Chief Executive, walks the talk and whips everybody to line. It is also high time, as my college has said, the Senate and the county assemblies got out of their comfort zone and offered incisive oversight on the county governments, to use and utilise the resources devolved to them for the benefit of the people. County governments were never formed to be a cash cow but they were ...

Hon. Temporary Deputy Chairman, as much as the proposals made by the Leader of the Majority Party are sound and responsible in the circumstances to safeguard national security, we must appreciate that the owners of the land adjoining any so-called safeguarding areas should be allowed as per the Constitution to develop their land subject to some reasonable planning regulations instead of being inhibited to develop the land to the fullest in regard to the highest and best use.

Again, I believe those who are in this practice of real estate and development are aware that one of the reasons we have so many unplanned developments in this country is that the cost of getting approval has been found to be prohibitive. Even an advert in the newspaper costs a substantial amount of money because it must reach as many people as possible. Secondly, when you need to print the necessary adverts and place them all over, it costs money. If you have to assemble the people, it also becomes a problem. Remember there is also a provision under ...

Hon. Temporary Deputy Chairman, I support and with your guidance probably we could expand and include other significant security installations. I look, for example, at the CID headquarters. I do not know if in the wisdom of the Leader of the Majority Party it is included. They are obviously controlled centres in terms of ICT and related issues. I do not know whether at this point in the legislation making we can expand that definition to include quite sensitive security installations from scrutiny by the planning processes.

Thank you, Hon. Temporary Deputy Chairman for this opportunity. My only concern is that planning as a discipline has very specific terms used all over the world. I feel in as much as we want to localise our planning procedures and practices, there are some honoured terminologies which we should not tamper with. Probably, we can retain the term “regional plans” but then redefine it in the context of our local situation.

Thank you, Hon. Temporary Deputy Chairman. As much as I support the amendments to the Bill, I am at a loss. Probably I have not clearly understood the rationale of having less than a quarter of a kilometre square. Probably the Chair of the Committee would be kind enough to explain further. Why not a kilometre? Why not two square kilometres? What is the scientific rationale of quarter of a kilometre square? Alternatively, I would request that they consider leaving the setting of the exact area to be covered to the Authority that is being established under this Act so ...

Thank you, Hon. Speaker. It is an opportune moment that I have to speak after the Member of Parliament for Mwea. I must admit that I was intimately involved in that project before I came here. As I rise to support this Bill, there are a few fundamental issues in the irrigation process that we must interrogate as a country and put right. The issue of compensation cuts across irrigation schemes and other Government projects. We must address them as a nation and comply with the constitutional requirements. Compensation must be fair, just and prompt. For record purposes, the valuation ...

In this country, we have not had lack of legislation and rules, but we have had a problem with implementation. It is unfortunate that many people who are entrusted with the responsibility to manage those authorities go there not necessarily to serve the people, but generally to squander or enrich themselves at the expense of taxpayers. If we do an audit or evaluate the performance of most of those authorities, it is dismal. Therefore, it is important that the new authority being proposed here is strong and capable of meeting the mandate and the provisions of this particular Bill. It ...
