Hon. Temporary Deputy Chairlady, I support the Chairman’s amendment. The previous clause was not very clear on how this management was supposed to be administered. With the amendment, everything is there and it is clear and not subjected to the Cabinet Secretary as it was previously.

Thank you, Hon. Temporary Deputy Speaker. From the outset, I rise to oppose this amendment Bill, if it sails through as it is. Unless it is amended, I oppose it. We need to look at the situation we were in before the promulgation of the Constitution, 2010. Article 67 of our Constitution was born out of the need of Kenyans. It was born out of the anger of Kenyans after seeing how land was being managed in this country. Recently, we saw that the Supreme Court is not beyond reproach. Most of these amendments were done after the Supreme Court had given its ruling on the opinion that was sought by the NLC. We now even have a member of the Supreme Court whose reputation is being queried and is facing a tribunal. We cannot make laws based on what the Supreme Court said. They are not beyond reproach. Is the Member, who is my Vice Chairlady in the Departmental Committee on Justice and Legal Affairs, in order to make insinuations to the effect that Parliament is not well equipped, and that PSC is superior and has more qualification to vet these people? We were in the right place.

Thank you, Hon. Temporary Deputy Chairman. I think that this substitution is very clear. These powers are only going to ensure that criminal activities within Parliament are controlled. Considering that Clause 37 (2) talks of the “precincts of Parliament”, we have visitors who come to our precincts and you never know what some of these visitors can do. If the officers have the powers of a police officer they will be effective in maintaining order.

Hon. Temporary Deputy Chairman, I stand to oppose. I am not really opposing the freedom that is envisaged in Article 34. Indeed, what we are purporting to delete is something that is self explanatory. Nobody should have the right and freedom to give false information. For example, it has been in the public domain that we are making laws that are bad to the Press. Surely, we have a process of making laws here. Hon. Temporary Deputy Chairman, I support the amendment. This is a confirmation that even former Members will be part of the Society. Clause 22(2) is a confirmation that we are really concerned with their welfare. We have seen that after leaving this House, Members tend to lead a life of confusion. If we can have this in our laws, indeed, their welfare and concerns are going to be addressed.
