Mr. Temporary Speaker, Sir, I wish to Second this Motion which requires the Senate to direct the Sessional Committee on Devolved Government to expeditiously inquire into the matter concerning Isiolo County, with a view of solving the wrangles in the County Assembly and report within three weeks. Thank you, Mr. Temporary Speaker, Sir, for giving me this opportunity to contribute to this very important Bill. In this new dispensation, we have to provide the necessary powers and privileges to the Members of the County Assemblies (MCAs) so that they can perform their responsibilities which, as we have realized, are weighty. This is because we have cases where when the Governors are called upon to appear before the Senate, they say that they are accountable to the county assemblies which up to now may not be having the privilege and power to summon those people. We voted for a Constitution which came up with the devolved units of governance and we have counties in place. Thank you, Madam Temporary Speaker. Despite the problem I have with my voice, I had to make sure that I contribute to this Report. I support it and would like to congratulate the Member who came up with the Motion which led to the formation of the Ad hoc Committee. Also, I would like to congratulate the Committee for having taken its time and come up with a very elaborate Report, which will lead to a legislation which will clearly set out how the natural resources of these counties will be exploited and how the benefit will actually be shared. ...

Thank you, Mr. Chairman, Sir. I support the amendment. I think we have had an experience in the last one year in the way the county governments and the assemblies have been spending money. Their expenditure has not been prudent because they have not been concentrating on developments. Most of these counties do not have proper county assemblies. They do not have the infrastructure and intend to go for easy money. That is why we are complaining about the trips that they have made. Mr. Deputy Speaker, Sir, the issue of Level 5 hospitals, from the list we have in Schedule 3, more than 30 counties are not benefitting. That means that the facilities below Level 5 so as to make sure that we all benefit, it is better to improve the county hospitals. The issue of additional funding from last year, I can see in my county, we got Kshs3.8 billion and now it is Kshs4.5 billion. We expect the additional funding to go to development. Mr. Temporary Speaker, Sir, we are sharing this revenue which as I have said has already been decided by the National Assembly. The Constitution states in Article 127 that it is the Senate which should set out the formula for the division of this revenue, whereas we have not set this formula. I think one year is a long time and it is time we looked at it. We have different parts of this country at different levels of development and that is why we talk of marginalized areas. Mr. Temporary Speaker, Sir, with regard to the Equalization Fund, my submission is that it is dismal and will not make much difference. But even that little amount has not been utilized because it has not been availed to the 14 counties which are supposed to benefit. When we inquired, we were told that the regulations are not in place. Who is supposed to put those regulations in place? Mr. Temporary Speaker, Sir, once we have allocated these funds horizontally among the counties, the main issue which all the Senators who have raised is how these funds are utilized. We know very well that the Governors are responsible for utilization of those funds, but the issue of prioritization and budgeting has to come from the communities. That is what is missing.
