Mr. Temporary Deputy Speaker, Sir, the key words here are “Parliament shall enact”. The Constitution does not say that it should be done in any other way. Therefore, I feel that it is unconstitutional to have two Commissions set up in this manner. Article 59(1) of the Constitution establishes the Kenya National Human Rights and Equality Commission. Mr. Speaker, Sir, is the Assistant Minister in order to give a commitment of three months when he is aware that when he appeared before the Departmental Committee on Local Authorities, he clearly said that they would be unable to proceed with work on any market because they had no funds available? He is now giving a commitment that he will do it in three months’ time.

Last week, the Assistant Minister for Environment and Mineral Resources who is here gave us an undertaking that no GMO maize will be imported into this country until it is approved. As of Thursday last week, she confirmed that there was no GMO maize that had been imported at all. Could the Prime Minister clarify whether that is the Government position or that was just the position of the Assistant Minister?
